Landmark court case on genetically modified food production begins

A landmark court case to decide on a farmer's right to produce genetically modified crops begins in the Western Australian Supreme Court today.

An organic farmer in Kojonup, Western Australia, is suing his neighbour for loss of income and damages after his property was allegedly contaminated with genetically modified (GM) canola.

Steve Marsh is claiming financial compensation after losing organic certification for about 70 per cent of his farm. He alleges his property was contaminated by GM canola material from Michael Baxter's neighbouring property in November 2010.

At the time, Mr Marsh's property was certified organic by the National Association for Sustainable Agriculture Australia (NASAA), which has a zero tolerance for GM material.

Guess he has no rights. The GMO farmer feels aggrieved because he is facing some potential financial repercussions. I wonder what he has to say about his neighbors already real losses

I have often wondered why suits like this have not been brought against farmers growing GMO crops especially given the aggressive defense of their so called property rights by companies like Monsanto

This is like the religious folks saying we are stifling their freedom of religion by banning creationism and beating up gay students in public schools.

He just cut his crop and left it on the ground and then harvested it. It was at this time that the other crop was affected. I hope he wins ...stuff those GM companies...didn't they screw over that Canadian farmer whose crop was infected and they sued him for stealing their genetic material....so unfair but then that's business...
