Oct 29, 6:25 PM EDT OKLAHOMA CITY (AP) -- The Oklahoma Supreme Court said Tuesday that a 2011 law it struck down as unconstitutional effectively bans all drug-induced abortions in the state, a finding that some legal experts said likely dooms the law's chances of being upheld by the U.S. Supreme Court.
The nation's highest court had asked Oklahoma justices to clarify whether the state law applied to three specific drugs that can cause abortions - including mifepristone, more commonly known as RU-486. In all cases, the Oklahoma court answered yes.
Oklahoma's Supreme Court in December upheld a lower court ruling tossing out the law, saying it created an "undue burden" on the ability of women to obtain abortions. A Republican-dominated Legislature passed the bill, Republican Gov. Mary Fallin signed it and Republican Attorney General Scott Pruitt appealed to the U.S. Supreme Court, which agreed to review the case.
Pruitt and the bill's sponsor, Rep. Randy Grau, said the court misinterpreted the bill's intent and that it wasn't as far-reaching as the justices said.

Oklahoma Supreme Court Rules Abortion Law Unconstitutional
The Oklahoma Supreme Court definitively ruled Tuesday that a 2011 restrictive state abortion law is unconstitutional.
In answering questions posed by the U.S. Supreme Court, the court ruled that the law "restricts the long-respected medical discretion of physicians and effectively bans all drug-induced abortions, according to the judge's order.
The Center for Reproductive Rights raised a legal challenge that prompted a district court to strike down the law in 2012, a decision later upheld by the Oklahoma Supreme Court. In light of Tuesday's ruling on the scope of the law, it is up to the U.S. Supreme Court whether to review the case.

Oh, sure. It was misinterpretation. They weren't trying to ban drug-induced abortions, just the drugs that are used to induce abortion. See the difference?

(9,462 posts)become law. This is happening in several states. They may be trying to waste all of Planned Parenthood's money defending the laws. What's so sad is the state taxpayer money wasted creating these unconstitutional laws.
