DeLay appellate lawyer: ‘We won the Super Bowl'

Source: Austin American-Statesman

A 3rd Court of Appeals panel, split 2-to-1 along partisan lines, on Thursday reversed the money-laundering and conspiracy convictions that ended the political career of former U.S. House Majority Leader Tom DeLay seven years ago.

The Sugar Land Republican was facing a three-year prison sentence before the court’s majority opinion ruled that there was “legally insufficient evidence” at DeLay’s 2010 trial before a Travis County jury.

The court, in effect, acquitted DeLay of all charges. He had been free on bond, pending the appeal.

Brian Wice, DeLay’s appellate lawyer, said he told his client: “When I see you, I’m going to dump a Gatorade bucket over your head. We won the Super Bowl.”

Oh sorry, I should have read the article. Goes next to the Texas Court of Criminal Appeals.

DeLay will die of old age before justice is done. Just like Kenny Boy Lay.

All are Republicans, but hopefully a few are sane enough to see what the other two teabagging judges just did.

And then ordered immediately to Huntsville to serve his time, plus an additional 25 to life.

DELAY ACQUITTED, SIEGELMAN STILL IN PRISON

. Siegelman, a Democrat, has so far served nearly two years for a "crime" that had never before been considered a crime before he was found guilty of it. He is likely to serve many more years in prison for the charges brought by Republicans, including a federal prosecutor whose husband was the Chief of Staff of Siegelman's gubernatorial rival Bob Riley, a team of folks, including the judge, who are all good friends of Karl Rove and who are said to have "coached, cajoled and threatened" the star witness in the case.

//////////////////////

Today, in the meantime, Tom DeLay, the former Republican leader of the U.S. House of Representatives, who was convicted of money-laundering hundreds of thousands of corporate dollars in Texas to give them to candidates --- something which has been an actual crime for decades in the state --- was acquitted of all charges by a 2 to 1 decision of a Texas appeals court.

DeLay never served a day in prison. Siegelman, on the day he was convicted, before the appeals process could even begin, was literally shackled and carted away. The basis for Siegelman's conviction has subsequently been challenged in a letter signed by a group of 113 bi-partisan former state attorneys general.

No need to make Siegelman wait three more years.

Not because I think the actions of the appellate court have anything to recommend, but because I think this ghastly news deserves more exposure to the DU audience.

I am appalled at this ruling. Not surprised but appalled.

The courts are highly partisan in most states, and at some level in the appeals process you're going to get a partisan outcome. The federal courts tend to be a bit more careful about the appearances of political outcomes, unless of course it's the SCOTUS.
