Little is known about suspected Boston bomber Dzokhar Tsarnaev's motives in the marathon attack, but Sen. Lindsey Graham (R-SC) already is calling on the Obama administration to label him an "enemy combatant," a status generally applied to suspected terrorists with ties to Al Qaeda or the Taliban that would give him significantly fewer rights. Tsarnaev is a US citizen.

a list of rights for US citizens (unless something is explicity mentioned to be pertaining to citizens).

Example, Fifth Amendment:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.


Note that these are restrictions on how the government operates (passive voice: "no person shall be…&quot , not a list of positive rights (active voice: "people are entitled to…&quot . Also note it refers to "people" not "citizens". It limits how the government treats anyone in its custody, citizen or not.

(However, the laws are different for people catured on the battlefield, because the constitution allows Congress to "make Rules concerning Captures on Land and Water", hence why -actual- POWs may be held until the end of a war, and people captured in Iraq/Afghanistan may be tried in military tribunals. Not that there hasn't been abuses there.)

Long story short, the Constitution limits the government and it applies to its actions towards ANYONE unless specifically mentioned.

Republicans want him dead so he can't speak and his history won't be well analyzed. Declaring him an enemy combatant and stripping him of his citizenship rights will greatly encourage his death.

Then they will be more able to demonize foreigners, especially non-Western European foreigners and most especially all muslims. If he can talk, he might interrupt their narrative.

It allows them to invent all kinds of theories, especially theories about failures by the Obama administration.

Facts get in the way of the Republican agenda, which includes permanent war so that the military-industrial complex can get corporate welfare.

It is bad enough that the cops are circulating Suspect 1's morque photo illicitly by emails. That only encourages them to shoot to kill. The suspect(s) is (are) more useful alive than dead to the US public, but more useful dead than alive to the Republicans.

Not on your life. These crimes were committed on American soil by an American citizen. This is a law enforcement matter that may involve enticement and support by others.

But there is no reason to consider this anything else, with respect to the suspect, anything other than a series of crimes.

Our justice system can handle this. This man deserves a fair and just trial according to our civil justice system.

At this point, collecting the intelligence is the most pressing need. After that process, a "clean team" untainted by any information received by the intelligence process can advise him of his rights and interrogate him for admissible information.
