Defense filing motion to dismiss, plus 2 other motions
Trump's defense team, after Judge Juan Merchan dismissed the jury for a lunch break, informed the judge they have a renewed motion for a mistrial plus two additional motions.
In in addition to seeking a mistrial, the defense will asking to preclude Karen McDougal's potential testimony, and seek to modify part of the limited gag order placed on Trump.
Merchan said he will break testimony early at 4 p.m. ET and handle the three motions then.
Before excusing the jury for the lunch break, Merchan announced that the trial is currently on or ahead of schedule.

(12,571 posts)p.s. in a sane environment specially after hearing shithole's many attorneys plead their client's cases in the different venues, and the one for immunity before the US SC, in a sane world would be denied.
His attorneys lack moral judgement, same for the RWer judges/justice.

(9,390 posts)Seems like, if Trump's attorneys were any good, they would have raised objections as she was being questioned, rather than waiting after the fact to assert that her testimony constituted improper or inadmissible evidence.

The details she gave were supposed to convince the jury that it DID happen, and that Trump was paying for those true facts not to be revealed.
His denial needed to be overcome with her credible tell-all on the stand.
Everybody squirming uncomfortably upon hearing it is Trump's own perjurious fault.

(33,211 posts)This is pretty standard stuff, am I right? Judges see these motions all the time, and they're easy to slap down. Since when has a judge ever said, "Oh you're rather have a dismissal? OK here you go."

He is asking for a mistrial, not that the charges be outright dismissed.
This just happened in a local case this week. A prosecution witness, on three occasions, mentioned irrelevant testimony pertaining to charges not in front of the jury. The defense objected each time, and after the third time the witness did it, the judge declared a mistrial based upon the motion from the defense. The key is, the defense immediately objected during testimony - and the judge agreed that the witness should not be mentioning what he did, told the witness to not do it again and the witness still did it again. You don't remotely have those elements here.
This explanation is very helpful for us non-lawyers.

In this case they are reporting on the spot. I saw one on MSNBC spelling a word with an extra letter. A minute or so the extra letter was removed.
