Supreme Court allows Texas to begin enforcing law that lets police arrest migrants at border

A divided Supreme Court on Tuesday allowed Texas to begin enforcing a law that gives police broad powers to arrest migrants suspected of crossing the border illegally while a legal battle over the measure plays out.
The conservative majority's order rejects an emergency application from the Biden administration, which says the law is a clear violation of federal authority that would cause chaos in immigration law.
Texas Gov Greg Abbott praised the order -- and the law -- which allows any police officer in Texas to arrest migrants for illegal entry and authorizes judges to order them to leave the U.S. The high court didn't address whether the law is constitutional. The measure now goes back to an appellate court and could eventually return to the Supreme Court. In the meantime, it wasn't clear how soon Texas might begin arresting migrants under the law.
It was also unclear where any migrants ordered to leave might go. The law calls for them to be sent to ports of entry along the U.S.-Mexico border, even if they are not Mexican citizens. But Mexicos government said Tuesday it would not under any circumstances accept the return of any migrants to its territory from the state of Texas. Mexico is not required to accept deportations of anyone except Mexican citizens.

Mexico's government said Tuesday it would not accept the return of migrants that Texas orders to leave the U.S. after the Supreme Court allowed the state to enforce a strict new immigration law signed by Republican Gov. Greg Abbott.
The law empowers police in Texas to arrest migrants suspected of crossing the border illegally. Once in custody, migrants could either agree to a judge's order to leave the U.S. or be prosecuted on misdemeanor charges of illegal entry.
Mexico's Foreign Affairs ministry said "it will not accept, under any circumstances, repatriations by the state of Texas."

Abbott is going to have to pay for flights that bypass Mexico to India. And China. And Guatemala . . . and so on and so forth.
The fast growing populations of undocumented residents are India and China immigrants.
He can't just pick.on the Latino/Latina population.

(31,823 posts)I'm old enough to remember the outrage from folks outside of New Jersey when Governor Murphy took down the Mississippi State flag from our State Park.
It shored up ( pardon the pun) the Democratic Party vote and gained him some respect from non-Democratic Party members. States Rights!

And don't come crying to us when that sweet, sweet federal cash dries up, along with the entire economy (and jobs) built on it.

A three-judge panel of the New Orleans-based 5th U.S. Circuit Court of Appeals split 2-1 in saying in a brief order that the measure, known as SB4, should be blocked. The same court is hearing arguments Wednesday morning on the issue.....
The appeals court appeared to be taking the hint from the Supreme Court, which in rejecting an emergency application filed by the Biden administration put the onus on the appeals court to act quickly.
"If a decision does not issue soon, the applicants may return to this court, conservative Justice Amy Coney Barrett wrote in a separate opinion joined by fellow conservative Justice Brett Kavanaugh.

(Yeah, it's bad, but the Supreme Court says "go ahead"---
so let it be "educational" for those who ought to be voting Democratic in Texas,
but perhaps are not)
