Aileen Cannon Sides With Donald Trump Over Counterintelligence Chief

Judge Aileen Cannon has granted Donald Trump a delay in his classified documents case, despite intense objections from prosecutors. Cannon granted Trump a 10-day extension after hearing that he and his lawyers are preparing for Trump's Stormy Daniels hush money trial in New York, which begins later this month.
The objection was placed in court by Jay Bratt, chief of the Counterintelligence and Export Control Section (CES) of the National Security Division of the Department of Justice. Bratt has been brought in to the case as a specialist legal adviser as national security documents were allegedly found at Trump's Florida estate.
Trump is facing 40 federal charges over his handling of sensitive materials retrieved from his Mar-a-Lago estate in Palm Beach, Florida, after leaving the White House in January 2021. He is accused of obstructing efforts by federal authorities to return them. Trump has pleaded not guilty to all charges and is almost certain to be the Republican candidate in the 2024 presidential election.
He is also due to go on trial on March 25 to face 34 charges over allegations he instructed attorney Michael Cohen to pay adult film star Stormy Daniels $130,000 to keep an alleged affair between her and the former president a secret ahead of the 2016 election. Trump is accused of listing the payment to Cohen as "legal fees." The former president denies having an affair with Daniels.

For decades, the Repubs packing the courts during their administration has mostly gone un-noticed.
Many of us have noticed it and commented on it, long before now.......
They knew 40 years ago it would come in handy sometime in the future, and here we are!

(8,923 posts)We all know that McTurtle withheld a SCOTUS appointment for almost a year and then hypocritically filled a SCOTUS seat within weeks. but he withheld judgeships as well in the lower federal levels.
Ask Obama how many judgeships were withheld? It was in the 100"s and I'll bet that Obama knows the exact number.

Yes, they reversed her decision regarding the appointment of a special master, but court of appeals reverse district court decisions all the time.

(42,757 posts)I have little reason to doubt that in some other cases of hers, the 11th Circuit has or will affirm the outcomes.
My point is that there is no reason to think that the 11th Circuit as a whole, or individual judges on the court, "hate" her or won't affirm anything she does going forward.

(6,562 posts)The significance of the Hush Money case is not that he paid a sex worker for a dalliance. It is the fact that he paid in order to deceive the public because of the election. He didn't want that getting out. That's what raises the charge from a misdemeanor to a felony. If Bragg can connect the dots, tRump is going to be sentenced to prison. That would make him a felon, and the results of this trial will be significant.

(6,562 posts)I also think that the Docs case is the one he should be caught on, for several reasons. 1) While I don't condone what others have done, they got tossed in the can for far less than Trump has done. To let him off is very unfair. 2) Experts have said repeatedly that this case would be the easiest to get a conviction on. 3) He's a traitor. The wide range of docs he took defies credibility; his efforts to conceal the docs is malicious. He endangered our national security completely, which will probably take us decades to repair, if we even can.
I used to have a Top Secret Crypto clearance, and it grieves me that the likes of Donald Trump can run around in this manner and apparently get away with it, and that so many people who have power are supporting this POS. I think that most of these people are desensitized to what it means to live under a dictator. If Trump returns to power, we can add "murderous dictator" to the national dialogue.
It's not looking good for "Judge" Cannon. What are people thinking?? How did Trump gather together so many losers of this caliber? I dunno, I just want Alvin to WIN! WIN, dammit!
If Alvin's case comes up and about eight weeks from now, Trump is a felon, I'll take it! You know, Trump is out on bail for the other Jack case. I'm hoping that somehow this figures in to what J. Merchan does when/if Trump gets convicted. I want to see Trump's ass placed in a jail cell. Even if he bails out in just a few hours, still he will be put behind bars, where he belongs.

I don't see why they need a delay, because she hasn't reset the May trial date. Perhaps she has not changed that is because she can use it to control the delays which are occurring. I long ago accepted the fact that this trial will not go forward until 2025. My worry has shifted that this clearly biased judge will give him a slap on the wrist for extremely egregious conduct. There is no reason for anyone to include nuclear weapons information as their personal possession, especially for a man who was so disinterested in classified briefings that he would not attend them, or had to be briefed with one page bullet pointed documents.
I'm surprised he even could understand what he stole, and I worry that he filched them on custom orders from other countries. I believe we still have missing documents. I trust Jack. Someone with experience recently said that it was harder than hell to get a judge thrown off the case. It's one thing to get her overruled, but the 11th circuit would have to be the ones to throw up their hands and say they are tired of her ignorance, or whatever the hell she is doing. "...having prejudice or a conflict of interest..." may be harder to prove than we think.

(42,757 posts)Yes, the important fact is that Cannon granted the motion for a ten day delay in the deadline for Trump to file replies to the oppositions that Smith filed to certain of Trump's pre-trial motions to dismiss. However, describing the prosecution's objection to the delay as "intense" is pretty hyperbolic. The objection was seven sentences long. IMO, it didn't need to be any longer, but I wouldn't characterize it as "intense". Moreover, the fact that Bratt signed it is blown out of proportion. The objection doesn't claim any specific national security issues and Bratt "signs" all of the filings in this case -- even pro-forma speedy trial reports.
As stated, I would have preferred for Cannon to deny the extension, but I'm not shocked that she granted it and I doubt Smith is shocked either. Such extensions are not uncommon.

(5,851 posts)Getting another judge up to speed will ensure that the case won't be tried before the election. He must think he still has a chance to get it done before November. He waited too long.
Goddammit. This is the EASIEST case to prove and America NEEDS to know just how much of a security risk he is before the election.
He shouldn't even be on the goddamn ballot.

But it's more than just delays. Cannon can keep her thumb on the scale by making rulings regarding admissibility of evidence and she can hamstring the trial in a lot of other ways. She's already made stupid rulings and Jack Smith didn't call for her recusal yet. I don't think he will.
I wonder if he's been told by Garland not to ask for her recusal. I know Garland is supposed to be hands off, but you know how averse Garland is to making waves. It would not surprise me if Smith was given certain parameters to stay within - by Garland.

THE COURTS ought to have learned that by now and put a stop to it. UNFORTUNATELY, in this case, the damn legal system in the US FAVORS the defendants, not the prosecutors. Normally that might be a good thing but NOT in the case of a lifelong criminal sociopath who knows how to manipulate situations, people and courts to his favor.

(129,414 posts)The NY hush money case delay wasn't 45's doing but was SDNY's fault due to a doc dump.
But "all of them" are NOT "on hold".
As I posted in another thread, over 1/2 a billion $ is due to be relinquished (whether as "cash" or as a "bond" ) in less than 10 days for the apparently forgotten NY civil fraud case.
(ETA to note that the GA criminal case is not "on hold" anymore either with the resolution of the special prosecutor issue)
