Justice Minister declares all same-sex marriages legal and valid (Canada)

All same sex marriages performed in Canada are legal and the law will be changed to ensure that divorce is readily available to non-residents who were married in the country, Justice Minister Rob Nicholson says.

Speaking at a Toronto luncheon Friday, Mr. Nicholson blamed the Liberal government that preceded his for not filling a “legislative gap” that has left thousands of same-sex couples in an agonizing position of being unable to divorce should they feel a need to.

the CONS are trying to sneak in an attack on same-sex marriages by trying to say there was a gap when there was none.

"But the marriage law already applies to all marriages performed in Canada, according to Kathleen Lahey, a lawyer who represented before the Supreme Court of Canada one of the couples fighting to be married.

Lahey, who also appeared in front of a parliamentary committee when the government was drafting the law, says there's nothing in the Civil Marriage Act that needs to be changed to make it apply to non-residents.

"Plain and simple, it is totally valid here. It’s a quite tragic attempt, really, to attack overseas same-sex marriages sort of from the side."

The "Harper Government" and it's supporters are rabidly homophobic and, with re-opening the Civil Marriage Act for amendments, in order to change that which does not need change, smells of back-door crap to me.
