US Government Sides With Bayer In Roundup Cancer Lawsuit
Source: CBS News
Shares of Monsanto parent Bayer surged Monday after the U.S. government put itself in the German company's corner, arguing that a ruling that found the pesticide Roundup caused cancer should be overturned.
In a friend of the court brief filed Friday with a San Francisco-based appeals court, the Environmental Protection Agency said it reviewed and approved the warning label on the weed-killing product, and that a jury finding based on California law should be reversed. The Department of Justice joined the EPA in weighing in on the only federal jury ruling thus far in a long-running saga over Roundup.
Over the summer, a U.S. district judge slashed to $25 million the amount to be awarded in the case of a man who claimed his non-Hodgkin's lymphoma had been caused by years of using Roundup. But the judge declined to reverse the jury finding that Roundup was defective because its label did not include a cancer warning. Monsanto maintains Roundup is safe.
Roundup contains glyphosate, which is being tested in the courtroom and in America's homes amid concern about the chemical's safety. Tests from environmental groups have added to consumer worries, such as one study that found 21 oat-based cereal and snack products, including Cheerios, contain traces of glyphosate. The most widely used herbicide in U.S. agriculture, glyphosate is used by farmers and sprayed on golf courses and residential lawns to kill weeds. -More...

(3,473 posts)They said it should be reversed, but don't have the power to reverse it? Does this now move on to a higher court and is the DOJ and EPA going to provide assistance in Bayer's defense?

(65,076 posts)...you separate the abstraction of corporation from the people that work there.
I personally know folks working on a replacement to glyphosate. It's tangentially related, chemically, but is far less metabolizable so it's expelled from the body the way it went in, hence safer.
They work for these same corporations, so somebody in the power structure is willing to fund the R&D to replace an already successful and efficacious product.
These folks I know aren't the bad guys creating a chemical morass.

Glad not every route out is blocked by the desire to maintain a lucrative status quo.
Merry Christmas.

(16,079 posts)And when will this replacement be ready? When it's most profitable for the corporation?
With the US Government in their corner and a good chance that Trump's judges will decide in favor of Bayer, it's more likely that those folks you know, are wasting their time!!!
And what exactly are those folks you know going to do, when they get the word that there won't be a replacement, not yet!
It's kind of like this: if a good cop sees a bad cop committing a crime and says nothing about, then you have two bad cops!
As for me, until there is a replacement, those folks you know are just not as bad as the real bad guys...

(65,076 posts)To both of you who missed the point.
I'm defending nothing but people with conscience who work for these otherwise faceless entities.
And, as to the "when" question.
Not a reasonable question.
Their existing product already works, they are profitable, and the overhead and material costs have been streamlined.
The replacement product cannot & will not be more profitable, except potentially as a competitive advantage for introducing a safer product.
Many have been as brainwashed by the "Wall Street" message of greed being good just like those brainwashed in the 70s & 80s Bschools that nothing mattered but shareholder value.
One side is to blame, but clearly both sides are blinded by propaganda.
