Judge blocks New York from turning over Trump's tax information to Democrats
Source: CNN
Washington (CNN) A federal judge on Thursday issued an order blocking New York state from turning over President Donald Trump's tax returns to congressional Democrats for now, should the House Ways and Means Committee request them through a newly passed New York law.
The limitation will be in place, Judge Carl Nichols wrote, while allowing New York to challenge whether Nichols' courtroom in Washington is the proper place for this case, brought by Trump, to move forward, and in what form it could proceed.

The state law allows Congress to request the taxes... this action enjoins Congress from making the request.
States rights aren't involved.

It means that legislators can't be prosecuted personally for their official actions... but that doesn't mean that courts lack the authority to enjoin them from taking certain actions.
That certainly includes a temporary restriction while the court determines whether the case can even be advanced in that court in the first place.

(26,754 posts)Congress has not yet requested the records from the state. If the state were to turn them over without such a request, the new law wouldn't help them.
