Schiff: Gates, Flynn negotiating with committee about testifying, won't meet subpoena deadline

Former Trump campaign deputy chairman Rick Gates one of former special counsel Robert Muellers crucial cooperators has begun providing documents to the House Intelligence Committee, Chairman Adam Schiff said Tuesday night.
The California Democrat said Gates and his attorney have been negotiating with the committee about in-person testimony as well, and we believe were making progress.
The panel has also contacted a lawyer for former national security adviser Michael Flynn, another Mueller cooperator, about scheduling an appearance as well.
The Intelligence Committee had subpoenaed both Gates and Flynn to provide documents and appear for testimony by Wednesday, but Schiff acknowledged that neither man would meet that deadline. Flynn, in particular, has recently seemed to shift legal strategies, dumping his team of lawyers in favor of a prominent critic of the Mueller investigation.

(32,640 posts)And the correct term is "defying a subpoena," which still doesn't apply. That is what Don McGahn did, not Flynn and Gates.

Legal processes and terms can very frustrating to those who don't know much about them and want action RIGHT NOW like you see in a movie. As they say, "God writes lousy theatre."
Perhaps some will be furious with "process" until Schiff pulls out a pistol and says, "Feeling lucky, Punk?" but they would also be just as furious if someone got off on a technicality because someone didn't follow that "process" to the letter.
But do go on. Perhaps you have a short memory.
I'm sure that some will find something to be angry about when they do get Flynn and Gates to the table...

(32,640 posts)Because that's the first step. If they don't honor the subpoena, you can then go to a judge and say, "We tried a subpoena." Because a judge issuing a search warrant would ask, "Well, did you try a subpoena?" There is a process, and House Dems are going to stick to the letter of it.
That is the rule of law.... if it's not Chuck Norris enough for some, they're just going to have to stew in their own juice about it.
We're not the GOP. And if we don't dot our i's and cross our t's, then people are going to be yelling, "Why the hell are they getting off on a technicality??? What the hell were you thinking when you just went and arrested them without due process? "

(15,290 posts)to co-operate with all other investigations. I don't see how he gets out of testifying unless he completely withdraws from his plea agreement. I suspect Flynn/Flynn's lawyers don't really want to scrap the plea agreement as much as argue it was "entrapment" of some kind.
