A pregnant woman was shot in the stomach. She was charged in her baby's death.

Marshae Jones of Birmingham was five months pregnant on Dec. 4 when an argument broke out between her and another woman outside a Dollar General, AL.com reported. The fight, which police said was over the fetus’s father, led 23-year-old Ebony Jemison to shoot Jones in the stomach. The mother survived the shooting, but it resulted in a miscarriage.

Jemison was charged with manslaughter, but a grand jury failed to indict her, and the charge was dismissed, according to AL.com. At the time, police alleged that Jones started the argument and that Jemison shot Jones in self-defense. Pleasant Grove police Lt. Danny Reid told the outlet a grand jury would consider charges for the mother as well.

“The investigation showed that the only true victim in this was the unborn baby,” Reid said in December, in the days following the shooting. “It was the mother of the child who initiated and continued the fight which resulted in the death of her own unborn baby.”

On Wednesday, a grand jury indicted Jones on a manslaughter charge, AL.com reported. She was being held Thursday on a $50,000 at the Jefferson County Jail, records show. It is not clear whether Jones has an attorney.

was being attacked by the pregnant woman. Another person tried to stop the attack but the pregnant woman continued. The woman with the weapon protected herself. If a person attacks me I shoot them, but then I'm a 76-year-old disabled veteran.

So let me change that to if she is found guilty of attacking the other woman and in doing so she put her condition in great risk and the fetus was killed because of her actions I hope she never has a child. I am an independent who has voted for Democrats about 95% of the time and Republicans about 5% of the time but the last time was for Mass. Senator Ed Brooke. Please explain to me how my post had anything to do with party affiliation. I have vascular dementia and write the best I can.

Why not shoot in the chest or head if she was presenting such a deadly threat?

And there's no dispute the the argument was over the fatherhood of the fetus? Just drag the shooter into court and raise a reasonable doubt that it was NOT her intent to destroy the fetus out of jealousy.

But why stop there? In the absence of birth control or marriage, the pregnancy shouldn't have occurred, right? So if the mother's actions toward the fetus were reckless and negligent, surely the father's were too. Let's put the blame on ALL the culprits!

I could see Trump's sex worker, the first naked lady, having a big old public fight with Ivanka. Maples and Ivana had a big old fight in some ritzy ski resort that went public or was it Maple and the sex worker? I get all those wives and mistresses mixed up. I imagine they have fights like this regularly but the weapons are put away.

I imagine many a rape victim of Trump's has had to abort his fetuses too. Hopefully not with weapons.

Orange Mussolini made the brilliant and admirable move of bringing his mistress at the time (Maples) on a family vacation and had her put up in a room a couple floors below the family. I think it was the last straw for Ivana. There's no doubt in my mind she knew about Maples...wives always know when there's a mistress, and he had multiple ones during their marriage. But this was rubbing her nose in it, and I think she had enough.

Prosecutors drop case against Alabama woman charged with her fetus' death

Bessemer Cutoff District Attorney dismissed the manslaughter charge...

Lawyers for Jones said in a statement ...that they were "gratified" that prosecutors chose to drop the case, which was "neither reasonable nor just...The District Attorney’s decision will help Marshae continue to heal from this tragic event and work to rebuild her life in a positive and productive way," the statement said.

...(P)olice said Jones started the fight, and Jemison, 23, ultimately fired in self-defense — though Jones was not armed. The same grand jury then said Jones did "intentionally cause the death" of her unborn child by allegedly starting the fight....

“The person with the gun is the one responsible for the loss of the fetus,” Toni Van Pelt, president of the National Organization for Women (NOW), said to NBC News in a statement last week...ACLU Deputy Legal Director Jeff Robinson said..."The DA's decision represents precisely what we want to see in these critical moments...prosecutorial discretion and power to refuse...when the law and justice demands that charges should be dropped..."

While you ought to be able to be charged with intentionally causing the loss of someone else's fetus, the charges of assault, manslaughter, and murder against the fetus don't fit because they only can happen to people who actually exist. Thank goodness that it dawned on the DA that prosecuting Jones but not Jemison would be a (professional) suicide mission.
