Rudy Giuliani has an unmistakable New Year’s message for special counsel Robert Mueller: It is time for the chief investigator in the Russia case to be investigated in 2019.

In wide-ranging interviews with Hill.TV’s Buck Sexton and me on Wednesday and Thursday, President Trump’s defense lawyer pointedly accused Mueller’s office of destroying evidence by allowing text messages from now-fired FBI official Peter Strzok and his FBI lover, Lisa Page, to be erased in the Russia probe.

“Mueller should be investigated for destruction of evidence for allowing those text messages from Strzok to be erased, messages that would show the state of mind and tactics of his lead anti-Trump FBI agent at the start of his probe,” Giuliani said.

The Justice Department inspector general reported this month that it found large gaps in the preservation of official government text messages between Strzok and Page, the two top FBI agents who helped to start the Russia probe in 2016, who were having an affair at the time, and who expressed disdain for Trump.

19,000 emails from the period December 15, 2016 through May 17, 2017 were recovered. That period predates the appointment of Mueller as special counsel and the assignment of Strzok and Page to the investigation. Texts from the phones they used after being assigned to the special counsel's office were not recovered because those phones were wiped clean (and in one case reassigned to a different person) between the time Page and Strzok left the Special Counsel's office and the time the Inspector General requested that those phones be provided for inspection. One of the phones, I believe it was Strzok's, was inspected by DOJ personnel before it was wiped and nothing of substantive significance was found.

The gap in the FBI’s collection of messages, which affected 10 percent of phones, lasted from December 2016 to May 2017.

n the middle of 2017, both got new S7s. When each joined the special counsel’s team, they were also given those iPhones.

Now, notice a key point here: There were not going to be any messages on the iPhones related to the start of the Russia investigation because they didn’t get the phones until well after Mueller had been appointed! Unless Strzok and Page decided a year after the investigation began in July 2016 to start reminiscing over text about their theoretical plot to take down Trump, any messages on those phones wouldn’t have revealed anything about its genesis.

26. One point of clarification

Mueller was appointed special counsel in May 2017. The texts that remain unrecovered are those from the brief period in mid 2017 when page and Strzok were assigned to the investigation. Strzok’s phone was reviewed before it was wiped and nothing of consequence found. Page’s phone was not reviewed but any texts between her and Strzok should have been reviewed when Strzok’s phone was reviewed.
