Special counsel slams Michael Flynn's criticism of FBI interview

Washington (CNN)Special counsel Robert Mueller's team on Friday slammed a suggestion by Michael Flynn's lawyers last week that President Donald Trump's former national security adviser lied to the FBI not even a month into his tenure because he was caught off guard when two agents approached him.

However, Mueller's office said it would not change its recommendation that Flynn receive no jail time, given he has accepted responsibility for his actions and cooperated with the special counsel.

Mueller on Friday also released memos written by the FBI agents, and emphasized that when Flynn lied to them on January 24, 2017, about the substance of his policy conversations with then-Russian Ambassador Sergey Kislyak, he had already lied to several members of Trump's team and was "committed to his false story" that he and Kislyak did not discuss sanctions.

Flynn later said he had lied, and will be sentenced next week.

even though he's retired. I love this idea. But him down to private, take his pension AND forever be known as a convicted felon. It would also make sure he's punished if donnie pardons him.

...... Flynn’s behavior while he was active and even more so when he retired and really went off the deep end.

I think that is why Obama fired him, wasn’t it?

A retired officer is subject to Court Martial prosecution for offenses committed after retirement. Retirement from the military is different. Retired service members do not receive a pension. Rather, they receive retired pay - reduced pay for reduced service.

That being said, given that Flynn has already been subject to prosecution in a federal court. A court martial is also a federal court, therefore the same sovereign. He cannot be prosecuted by court martial for offenses that are the subject of a cooperation agreement in the US district court. It sounds like Flynn took full advantage of being "Queen for the Day" and sang like a whole flock of birds during his proffer.

All that to say, I can't imagine there will every be a court martial.

Sad situation with Flynn, who was by all reports a very effective counter-intelligence operative in Afghanistan and Iraq. Went totally nuts and full CT, RW wack-job after Obama fired him. That kinda happened with a lot of our fellow countrymen come to think of it. Minus getting fired by Obama, of course.
