WASHINGTON (Reuters) - U.S. House Speaker Paul Ryan said on Tuesday that it was not possible to end birthright citizenship with an executive order, after President Donald Trump said he was considering such a move, the Washington Post reported.

“You cannot end birthright citizenship with an executive order,” Ryan, the top Republican in Congress, said in an interview with radio station WVLK, according to the Post.

Most people born in the United States are legally entitled to U.S. citizenship, according to the U.S. Constitution and court decisions.

ouse Speaker Paul Ryan went against President Donald Trump on Tuesday after Trump said he planned to sign an executive order eliminating the right to citizenship for children born in the United States to non citizen parents. In an interview, Ryan rejected such a plan, saying “you obviously cannot do that.

“Well, you obviously cannot do that,” the speaker told radio station WVLK. “You cannot end birthright citizenship with an executive order. We didn’t like it when Obama tried changing immigration laws via executive action, and obviously as conservatives, we believe in the Constitution.”

"I think in this case the 14th Amendment's pretty clear, and that would involve a very very lengthy constitutional process," Ryan continued.

The first section of the 14th Amendment deals with birthright citizenship, stating that "all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

The president had not yet responded to Ryan's comments as of Tuesday afternoon.

its not really my area of expertise but as a litigator we deal with jurisdiction over the person and property both within and outside the United States or an individual state all the time. Its fundamental law that the United States has (personal) jurisdiction over the person of anybody who can be located within the borders of the United States (except perhaps foreign ambassadors). (ie recent Russian served with subpoena by FBI immediately after arriving at JFK Airport). What am I missing-or is this just bullshit?

There's no "perhaps" about it. There are diplomatic personnel who enjoy diplomatic immunity and therefore aren't subject to US jurisdiction. It's not just the ambassadors; IIRC their immediate families are also included, which is what's relevant here. Suppose that, while in the US, the ambassador or the ambassador's wife gives birth. That kid is entitled to diplomatic immunity as soon as he or she is born, and is therefore not a US citizen.

I think that some personnel below the rank of full ambassador also get immunity, but I know that not every embassy employee does so.

So, yes, as you say, the exception in the Fourteenth Amendment applies to very few people.
