(7,077 posts)The high road about due process in this exact moment - after at least 12 politically-motivated terrorist attempts on the lives of loyal Americans - will help us immeasurably, imho.

(37,748 posts)Courts rule on guilt and innocence, not discussion boards. We simply discuss and speculate. I doubt anyone is not hoping for a fair and deliberate application of justice.
We help our case by not loudly arguing against that which is, at worst, irrelevant and at its best, merely benign.
FreepFryer
(7,077 posts)We can sit back and smile, rather than froth.
LanternWaste
(37,748 posts)And our presumption of guilt or innocence is without consequence, and hence benign. Courts, not people decide as such.

(62,444 posts)It is not a moral principle.
If someone comes up to me on the street, points a gun at me, and takes my wallet, then I do not have to presume that person is innocent of mugging me. That's just ridiculous.
Furthermore, the prosecutor at a trial certainly walks in and says, "That person is guilty" from the word go. It is, in fact, the prosecutor's job not to presume anyone is innocent, but to prove they are guilty and they certainly do say so.
FreepFryer
(7,077 posts)jberryhill
(62,444 posts)A "plaintiff" is a party in a civil suit, not in a criminal proceeding.
Look, if I see you shoot someone on the street, I don't have to believe you are innocent. If there was some general duty to believe accused people are innocent, then nobody would get arrested, tried, or convicted, of anything.
FreepFryer
(7,077 posts)jberryhill
(62,444 posts)All it means is that in a criminal trial, the prosecution has the burden of production and persuasion, and that the defendant does not need to prove anything if they don't want to.
It is not some sort of "rule to live by" for persons not engaged in a criminal proceeding in some capacity.
FreepFryer
(7,077 posts)jberryhill
(62,444 posts)If someone wants to believe this guy is guilty, then they are free to do so, and they are free to express that belief.
Expressing what one believes is also a basic freedom.
My belief that someone is guilty, and my saying that I believe someone is guilty, does not impact that person's liberty in any manner at all. Neither my belief nor my expression of it puts that person behind bars.
FreepFryer
(7,077 posts)jberryhill
(62,444 posts)I'm not going to go off into yet another legal issue with you, but to express one's opinion about something, and to clearly state that it is one's opinion, is not defamatory.
Statements which are expressed in the form of opinions are not actionable. I can say, "In my opinion, so-and-so is deranged" about anyone. It does not matter whether I have any sort of qualifications in psychology, or whether I am factually correct.
The First Amendment protects statements of belief or opinion.
Defamation occurs under certain circumstances in which someone makes false statements of fact about another person, and causes that person cognizable harm (i.e. harm which can be reduced to a dollar figure).
If I say, about anyone, "In my opinion, X" or "I believe X about that person" then my statement is always true - as a statement of my opinion or belief.

BREAKING: A man in Florida has been arrested in connection with the mail bombs, according to a law enforcement official.
Authorities on Friday recovered two more potential explosive devices sent to public figures, the latest packages addressed to Sen. Cory Booker (D-N.J.) and former director of national intelligence James R. Clapper Jr.
These packages recovered in Florida and New York push the total number of devices found by law enforcement to 12. None have detonated, but all have pushed officials onto high alert as they worry about additional devices being delivered.
The FBI said a package, similar in appearance to the others found this week, was addressed to Booker and located in Florida. A spokesman for Booker, a prominent Democrat and potential 2020 presidential candidate, declined to comment and referred questions to law enforcement.

(7,142 posts)if this is a Reichstag fire. I have been very uneasy about the way this has been unfolding. Right wing media was all over the talking point that this was a false flag from the very beginning. I pray to god this is not the case (Reichstag fire) but Republicans are as dirty and evil as they come.
We, Democrats, are in position to definitely take back the House and 50/50 to regain the Senate, there is absolutely no reason for anyone from the Left to send these bombs but there is plenty reason for a pal of Rudy Ghouliani to send these bombs and have a patsy set up to blame.
I pray to god this is not a Reichstag fire.
FreepFryer
(7,077 posts)The Reichstag stands. If you dread a Reichstag Fire and resulting Enabling Act, you might just dread worse the prospect that it has already happened, in the form of USA ATRIOT.

(24,931 posts)The targets were liberals. I would think if this were a false flag, it would be pipe bombs sent to Trump and his minions. Thus, making them the "victims" of liberal "mobs."

(7,142 posts)Be careful people are going to start piling on you. I called it a Reichstag fire where people on the right sent the bombs but had a patsy on the Left lined up to blame. That's all I was saying and worried about and I got hammered.
Well it certainly looks like the suspect is no Lefty, ehh?
Remember, Trump promised to pay his legal fees.

(1,204 posts)We have a guy who already not right in the head who gets pushed over the edge by Trump's rhetoric. Not exactly a new thing. He probably had some twisted vision that he would be hailed as a hero by the right and by his hero Trump. There is still time for them to start turning this guy into a hero. Once it becomes clear there is no way for them continue down the "hoax" narrative, I am sure some on the fringes will celebrate him and try to excuse his actions.

(22,134 posts)like this person, never will be, and hope this idiot loser gets the book thrown at him, preferably for life, since he was so indifferent to life with the handling of his bombs (if him) via the mail, etc. What's really sad about this whole mess is that there are probably more like this guy out there, old white male, loser, nutty as a fruitcake, paranoid as hell, and a sad and pathetic example of a human being.
Be aware of copycats. Be safe. Vote.

Oh and of course those who still claim it's an elaborate false flag hoax meant to frame Trump supporters. These claims are probably made by people with the exact same affliction as the attempted bomber.
