Bill Cosby Appeals Sexual Assault Prison Sentence, Lawyers Claims Judge Made Serious Errors

Attorneys for disgraced comedian Bill Cosby are fighting his recent criminal conviction and prison sentence for sexual assault, filing an appeal that claims the judge erred in handling the case.

Lawyers Peter Goldberger and Joseph P. Green Jr. argue that Judge Steven O'Neill should not have allowed testimony of other women who have accused Cosby of sexual assault to be admissible in the trial, which only dealt with whether Cosby sexually assaulted Andrea Constand in 2004.

Additionally, Cosby's team claims that Judge O'Neill went too far with his sentence of three to ten years behind bars, plus deeming him a "sexually violent predator" who needs to register as a sex offender. O'Neill defended the sentence when he issued it on September 25.

"Any lesser sentence would seriously depreciate the seriousness of the crime," he said, noting, "We can't treat him differently because of who he is or who he was."

to allow the other women to testify as it could jeopardize any conviction.

I thought it was a risky move to allow them to testify because it opens the door for an appeal.
I do wonder now though if Cosby and his lawyers planned this and went out of their way to cloud the judges thinking with enough anger so the judge would allow the testimony of the other women so they could have grounds for appeal.
After all remember how Cosby was behaving before and during the trial and its just not a good idea to attack the DA and the justice system in an ongoing criminal case usually.

he was not convicted in the past thus any testimony from them tainted his trial and that is why I would not be willing to wager any money on the courts not throwing his sentence out.

10. But it CAN be used. Of course Cosby can argue the prejudice outweighed the probity.

That argument is made in just about every appeal.

In this case, the shear number of witnesses who came forward to attest to similar prior incidents of drugging and rape is overwhelmingly probative of a modus operandi. If it was just one prior incident, he might have a argument.

it again and he felt privileged to do these terrible things and so continued them for decades.

He really didn't get what he deserved. He needs at least a minimum of five years.
