Apple pushes for Samsung Galaxy S3, Note and Tab 10.1 tablet ban in US

Samsung's flagship Galaxy S3 and Galaxy Note smartphones, and its Galaxy Tab 10.1 tablet, could be banned in the US after Apple asked a federal court there to ban them as part of an ongoing lawsuit it is bringing against the South Korean company.
The iPhone maker has added the phones to a case which is running in parallel to its just-concluded patent infringement case, where a jury awarded Apple $1.05bn in damages after deciding a number of Samsung phones and tablets had infringed various software patents as well as mimicking the iPhone's appearance.
Meanwhile in Japan, Apple lost a claim against Samsung, where it alleged similar infringements, providing a welcome relief for Samsung, which has had few outright wins in the dozens of cases being fought in courts around the world between the two.

I can see this settling down ,at least for the time being, with Apple having the US and Samsung the rest of the world.

(42,239 posts)Since posting this subject I've bought the current Note N7000 having read up on it and decided the Note 2 had features I didn't really need. It really only so's I can take pictures to post on FB with written info saying "wish you here - NOT !"
Its not an issue here in the UK anyway. Here it was not found in favour of Apple the judge more or less saying " you're having a laugh patenting a rectangle with rounded corners." At the time I got my Galaxy 10.1 Tablet last year there was a temporary ban on import by the EU excluding Holland who told them to whistle simply saying " NO - we're not banning them !" I think as such mine came in from Holland via Ebay here.

(5,668 posts)I think your the majority, another news piece probably pro Apple had it that Samsung users were in panic mode over future updates and were trying to get rid of them. Which makes no sense. trust me Samsung would provide future update and no problem there. They'd probably be on the high ground if apple sued them on updates.

(152 posts)The Galaxy S3s looks very little like an iPhone. They just want it off the market because it's better. I hope everyone hears about this, so they can vote with their money. And hopefully decide to never buy Apple products. After this I know I will take special care to avoid all of their products.

(403 posts)How can you tell they are better? Use them. I know I do. That is what Apple is really afraid of. A superior product at a price that matches the value you get. I use Apple products at school, but on a dollar for dollar value I'll take anything but apple everytime.

However, the S3, the Note and the galaxy tab look very little like the apple competitor products.
This is the shit that apple tried to do to Microsoft.
If this stuff happened in the early lightbulb days, gas lamp makers could have prevented lightbulbs from going on the market because they were light making devices.

(4,756 posts)Samsung confirmed that it will immediately sue Apple if the latter releases products using advanced long-term evolution (LTE) mobile technology. LTE has been emerging as the top standard in the global mobile industry.

Samsung can, if need be, update the SIII software to AOSP 4.1 (Android Open Source Project, the 100% GPL'ed reference Android distribution maintained by Google) the latest version has been specifically cleaned up to avoid the infringements Apple is currently alleging; if their allegations of Apple not licensing LTE patents are true, it's a much worse situation for Apple - the HARDWARE is in violation so there's literally nothing to do but pull it.
Not to mention Apple is quite dependent on Sammy both for a majority of their display panels including the precious precious "Retina" displays and literally the ENTIRE supply of A5 processors for the iDevices; they're trying to move to Sharp as the supplier for the iP5 screen and have literally junked the company. If Apple keeps this up, Samsung just might decide the loss of revenue is worth pretty much starving the supply of EVERY Apple product on the marketthere's no law that says contracts have to be renewed. Oh, that would be epic...

(42,239 posts)and as such I doubt they will retaliate using parts supply which actually represents c.40 % of Apple products. Pricing may be a different issue - they can make up any royalty payments by increasing the supply price of parts to Apple.

They profited $2.2B on sales to Apple last year, if Apple is able to hit them with another multimillion-buck fine plus sales bans on basically their entire line it just might be worth Sammy's loss to drag Apple down with them. I don't think it's imminent, nor even seriously thought about at this point, but given Apple's open intention of total destruction, I can see it being a last-ditch MAD-type thing.
The LTE patent thing OTOH...God that would be awesome.

Thats just my opinion though.

Apple is running scared because Samsung and other companies are making phones as good as if not better that iPhones.
Also, since Apple buys phone components from Samsung how can their phones NOT be alike?
