UPDATE: Federal judge allows emoluments case against Trump to proceed
Source: Washington Post
A federal judge on Wednesday rejected President Trumps latest effort to stop a lawsuit that alleges Trump is violating the Constitution by continuing to do business with foreign governments.
The ruling, from U.S. District Judge Peter J. Messitte in Greenbelt, Md., will allow the plaintiffs in the case the attorneys general of Maryland and the District of Columbia to proceed with their case, which says Trump has violated the Constitutions little-used emoluments clause.
The plaintiffs now want to interview Trump Organization employees and search company records to determine which foreign countries have spent money at Trumps hotel in downtown Washington.
The Justice Department and Trumps attorneys did not immediately respond to requests for comment. They could try to appeal the decision to a higher court and ask Messitte not to allow the attorneys general access to Trump Organization employees and books until the appeal is decided.

The suit is one of several centering on the Constitution's emoluments clause, which bars federal officials from taking payments and gifts from any "King, Prince, or Foreign State."
Filed last year by D.C. Attorney General Karl A. Racine (D) and Maryland Attorney General Brian E. Frosh (D), it focused on the money foreign governments have spent at President Trump's D.C. hotel to rent rooms and hold events.
Although Trump has said he gave up day-to-day management of his businesses, he still owns them and can withdraw money from them at any time.
This is a developing story. It will be updated.

This is related to one of the Emoluments Clause lawsuits which can now go forward.

A federal judge on Wednesday once against rejected President Donald Trump's efforts to get a lawsuit challenging the constitutionality of his financial ties to his Washington, DC, hotel dismissed.
The District of Columbia and the state of Maryland sued Trump last year, claiming he had violated the Foreign and Domestic Emoluments Clauses of the US Constitution by refusing to give up his interest in the Trump International Hotel in DC and then profiting from the business of foreign, state, and local governments. In the latest phase of the case, the fate of the lawsuit turned on how exactly US District Judge Peter Messitte defined an "emolument."
Messitte wrote in Wednesday's opinion that he had adopted the broader definition of "emolument" meaning any "profit," "gain," or "advantage" argued by the challengers, and that DC and Maryland had "plausibly alleged" at this stage that Trump was receiving or able to receive "emoluments" in violation of the US Constitution.
It's the latest loss for the president and the Justice Department in the Maryland litigation. Messitte, who sits in Greenbelt, Maryland, ruled in March that Maryland and DC had standing to pursue claims against Trump, over the government's objections.

(22,176 posts)interests by clearly favoring his own personal interests and not those of the country as a whole.
He's got local competitors all riled up in Washington DC because of his unfair advantage of having his own hotel there.
Businesses and other countries are trying to gain favor too, by staying at rump properties too.
I wouldn't be surprised before too long that he awards an exclusive lifetime contract to his Wash. DC hotel for providing lodging and/or dining services for all federal business in the Wash DC area...which of course is a clear violation of ethics. Just wait and see. And he'll attempt to propagate this concept to NYC, and other localities where he has hotels and/or other properties...
I think also that this is why he is not tough on Russia, because he is looking long term at his business interests in Russia, as well as China (ZTE) instead of American interests. Remember, he's hiring foreign workers too, a hypocrite. All about rump and no one else.
