Kavanaugh: Watergate tapes decision may have been wrong

WASHINGTON (AP) — Supreme Court nominee Brett Kavanaugh suggested several years ago that the unanimous high court ruling in 1974 that forced President Richard Nixon to turn over the Watergate tapes, leading to the end of his presidency, may have been wrongly decided.

Kavanaugh was taking part in a roundtable discussion with other lawyers when he said at three different points that the decision in U.S. v. Nixon, which marked limits on a president’s ability to withhold information needed for a criminal prosecution, may have come out the wrong way.

A 1999 magazine article about the roundtable was part of thousands of pages of documents that Kavanaugh has provided to the Senate Judiciary Committee as part of the confirmation process. The committee released the documents on Saturday.

Kavanaugh’s belief in robust executive authority already is front and center in his nomination by President Donald Trump to replace the retiring Justice Anthony Kennedy. The issue could assume even greater importance if special counsel Robert Mueller seeks to force Trump to testify in the ongoing investigation into Russian interference in the 2016 election.

Still, there's hope. After 7 decades communist China has not totally stifled dissent. After 8 decades the bolsheviks lost power (and regained it albeit as a oligarchy.) Maybe the USofA will only need to go through the cleansing for a few decades before those titular heads lose theirs.

Where does "robust executive authority" belong in the 21st century? Kavanaugh is the worst kind of person to sit on the SC. I am thinking he doesn't believe in representative democracy.

This is reminiscent of "the King can do no wrong" mentality of the middle ages in Europe. We left that notion behind in 1776. The president of the United States is NOT ordained by God to rule over us--he is ELECTED BY us (at least, that was the theory before 2000...but that's a tangent) to SERVE us. WE do not serve HIM. He is subject to the law of the land, or the Constitution of the United States means NOTHING! Let him be indicted, tried and convicted in a court of law like any other citizen. Then, if Congress will not impeach him, he can be president from behind bars.

And this "guy" sits on the bench presently, he thinks that a president that broke laws to defend and protect the Constitution first and foremost should get a 4 year pass just to break as many laws as possible...................time for some good old fashion protests................................this is just fucked up

There has to be some basis for his nomination being illegal if it was done for the sole purpose to protect the president against being held for crimes he committed.

.ee..the odious fool in WH brings on board--he/she is either complicit, corrupt and or has connections to Kremlin..eventually they all implode in one way or another, end up resigning or quiting, or fires and in some cases indicted and or arrested. So in essence kavanaugh is just temporary,..like trump. We'll just have to see it all play out like a damn novela with all the drama y todo.

The US Constitution provides for, and outlines the steps to impeachment, and yet he contends that a President is not subject to these laws.
Basically a no-brainer. Now we have to beat it into a few Republican brains.

and Justices William O. Douglas, William J. Brennan, Potter Stewart, Byron White, Thurgood Marshall, Harry Blackmun and Lewis F. Powell.

Here's something that must make his head explode, William Rehnquist was also on the court at the time but recused himself because he had served as Attorney General earlier in Nixon's presidency. I doubt we'll see that kind of integrity from any of Trump's appointees (and it kills me to say anything good about Rehnquist.)
