Trump launches bitter Twitter assault on lawyer Michael Cohen for illegal recording of incriminating conversations
TOM BOGGIONI

President Donald Trump kicked off his Saturday morning by launching an attack on his former personal lawyer, Michael Cohen, for recording conversations the attorney had with the president and that are now in the FBIs hands.
Without naming Cohen, Trump bitterly complained, Inconceivable that the government would break into a lawyers office (early in the morning) almost unheard of. Even more inconceivable that a lawyer would tape a client totally unheard of & perhaps illegal. The good news is that your favorite President did nothing wrong!

(10,437 posts)Cohen was busted and served valid search warrant. As for recording, a simple google can show whether or not Cohen had a legal right to do it or not.

(14,155 posts).... maybe then Cohen would not have felt he needed to tape every conversation to prove to the liar every word out of his mouth is a lie. How can you legally protect someone's interests if they refuse to tell you the truth ?

(15,696 posts)New York law is 1 party consent. Chicago is 2 party consent.
localroger
(3,628 posts)There are only a handful of 2-party consent states (where all parties on the line have to be aware of and consent to the recording). And if you wonder why it's legal almost everywhere, it's the cops -- 2-party consent makes it much harder to admit evidence from a CI wearing a wire.

(20,196 posts)Also, it would be hard to prove that someone had been making threatening phone calls if you couldn't tape. In my case, I got a former principal on tape blackballing me even though I had always gotten good evaluations.

(11,014 posts)Changing the subject to this since it was his team that probably leaked the tape's existence in the first place.

(52 posts)Without their consent. If the recordings were done in New York Trump Tower theres nothing Trump can do about it.

Trump has a long history of secretly recording calls, according to former associates
By Marc Fisher | May 12, 2017
There was never any sense with Donald of the phone being used for private conversation, said John ODonnell, who was president of the Trump Plaza Hotel and Casino in the 1980s.
For ODonnell and others who have had regular dealings with Trump through the years, there was something viscerally real about the threat implied by the presidents tweet Friday morning warning that fired FBI director James B. Comey better hope that there are no tapes of our conversations before he starts leaking to the press!
Talking on the phone with Donald was a public experience, said ODonnell, author of a book about his former boss, Trumped: The Inside Story of the Real Donald Trump. You never knew who else was listening.

(47,496 posts)And maybe Trump recorded his phone calls to Cohen. The man really hates when people do the same things to him, that he does to them. The outrage is absolutely adorable.

(79 posts)It's always everyone else doing illegal things to poor, pure, innocent Donald Trump. This is what guilty people do when they defend themselves.

(6,917 posts)Can't an oligarch-wannabe ripping off America get a break nowadays? I think Trump should produce his own recordings so we can compare the two.

(843 posts)There is a little matter Mueller is investigating that has not been in the news recently. Exxon wanted to enter into an oil deal with the Russians. Rex Tillerson (formerly of Exxon) got in as ecretary of State and was about to complete the Exxon-Russia deal when the investigators caught on to the situation. Tillerson has gone into hiding and Trump is ignoring the issue.
Robert Mueller is not ignoring the issue.

We can flip Rudy's narrative by asking him: where are the other "exculpatory" tapes at???

New York state's wiretapping law is a "one-party consent" law.
https://www.rcfp.org/reporters-recording-guide/state-state-guide/new-york
Cohen, by initiating the recordings himself, implicitly gave the needed consent of one party involved in the conversations with Trump.
