House Republicans Preparing To Subpoena Rosenstein For Comey Memos

House Judiciary Committee Chair Bob Goodlatte (R-VA) plans to subpoena Deputy Attorney General Rod Rosenstein for copies of the memos drafted by ousted FBI James Comey about his interactions with President Donald Trump.

Goodlatte’s plans were first reported by The Hill Wednesday evening, and Rep. Jerrold Nadler (D-NY), the Judiciary Committee’s ranking committee, later confirmed in a statement that Goodlatte informed him of the plans for a subpoena on Wednesday.

“Today, Chairman Goodlatte informed me that he intends to issue a subpoena to the Department of Justice—in this case, to Deputy Attorney General Rod Rosenstein—for former FBI Director James Comey’s memoranda,” Nadler said in a statement. “Although the Majority has shown little or no interest in conducting meaningful oversight of the Trump Administration so far, no matter what the Chairman’s motivations are today, I hope that we will now have an opportunity to review some of the evidence surrounding President Trump’s dismissal of Mr. Comey.”

Goodlatte, along with two other Republican chairmen in the House, sent a letter to Rosenstein last week asking for the memos by Monday, April 16. Rosenstein asked the committee leaders on Monday for more time to assess whether the Justice Department can share the memos given that they are evidence in an ongoing investigation. The committee leaders agreed to give Rosenstein a few more days.

go to court to challenge subpoena or put some restrictions on what GOP does with information?

If Nunes or other member of GOP in Congress is a subject of investigation - does Rosenstein have grounds to ask court to refuse
to allow subpoena pending completing investigation?

Rosenstein can not only appeal the subpeona, but he can also inform members of the House Judiciary Committee that they are on the block for obstruction of justice. NO ONE gets in the way of criminal investigations without paying a big price, and the Judiciary Committee is attempting to contaminate the evidentiary chain of custody and to derail the investigation.

I'd like to hear from legal experts about this, and will defer to more experienced folks.

Answer questions. They all work in the WH and are taxpayers employees, not trumps. Rosenstein is one of the most ethical, brave people on the hill. Probably why they are after him. They threatened to impeach him yesterday.

Were I betting, I'd say that the DOJ will refuse to turn over evidence in an active investigation to a leaky and antagonistic GOP. AND, I'd further venture a guess that the DOJ will defer to the Courts to back up their claim that the evidence is not public information at this time. The GOP, on the other hand, will attempt to "impeach" Rosenstein based upon his legally appropriate protection of evidence in an active investigation. Other GOP Congressional members will support this claim, and the "impeachment" effort will die in the wind. But this is all well-known beforehand. GOPers know that the effort won't succeed; they only want more hype that will feed into Trumpy's urge to fire the whole lot of the DOJ and FBI upper echelons. The Judiciary Committee is, of course, anything BUT Judicial. They are purveyors of Trumpian chaos, and "believe me", they will be paid handsomely for their efforts, because in the final analysis, this is a loyalty test.

Trump will then use that as a rationale to fire Rosenstein.

My guess is that Rosenstein is a known entity and is bad for trump legally since he won't change the course of the investigation. So he might as well roll the dice and try the next in line and see if they are any more compliant.

They can play this game until they find their new robert bork. Of course, bork's career pretty much died when he fired cox. The only work he could get was in a think tank giving speeches to the conservative rubber chicken circuit. Everyone in the line of succession has to know that spanky is a one term burden, and all protection will be gone in 2020.
