Judge Scoffs at Manaforts Doctor Letter Suggesting House Arrest Endangers His Health

The judge overseeing Paul Manafort‘s criminal prosecution today dismissed the notion that house arrest is detrimental to the defendant’s health–and then suggested that he get some exercise.

After rejecting a motion by special counsel Robert Mueller to begin Manafort’s trial in May, U.S. District Court Judge Amy Berman Jackson heard and referenced motions, arguments and documents entered by the defense.

One such document was a doctor’s note written on behalf of Manafort by his personal physician.

Jackson apparently referenced the document dismissively, telling Manafort’s attorney Kevin Downing that a doctor’s note wasn’t going to cut it and that a formal motion had to be submitted if Manafort wanted to change the the terms of his house arrest.

The criminal trial of President Trump’s former campaign manager Paul Manafort and his business partner, Rick Gates, will likely not start until September at the earliest — putting it extremely close to the 2018 midterm elections.

On Friday, special counsel Robert Mueller filed papers asking for a trial date of May 14.

At a status conference Tuesday morning in Washington, U.S. District Judge Amy Berman Jackson declined to set a trial date, instead scheduling another status conference for potentially setting a trial date for Feb. 14.

Jackson also set a hearing on April 17 for the first round of motions from both the defense and the prosecution.

Any hopes by President Trump that the special counsel’s Russia investigation will be wrapped up by the first half of the year were put into question Tuesday, with comments by a federal judge indicating the trial for his former campaign chair and another former aide might not begin until September or October, in the run up to the midterm elections.

U.S. District Judge Amy Berman Jackson declined to set a trial date for Paul Manafort and Rick Gates at a status conference Tuesday morning.

Instead, noting the massive amount of discovery the defense was having to work through, she suggested that the May date proposed by Special Counsel Robert Mueller’s team last week was too soon. She hinted that a date in September or October might end up being more appropriate.

Jackson said that a trial date would be nailed down after the first round of motions — in which the defense will have the chance to argue any defects in the prosecution or the indictment — are dealt with. Those motions and responses are to be filed in in February and March, she said, with a hearing on them set for April 17.

Special Counsel Robert Mueller’s team says the op-ed reflects an intention to circumvent court orders in the Russia probe.

President Donald Trump's former campaign chairman, Paul Manafort was ghostwriting an op-ed with a Russian with ties to the Russian intelligence service while out on bail last month, Special Counsel Robert Mueller's team said, CNN reported.

Manafort was working on the op-ed, written in English, as recently as Nov. 30. It related to his political work in Ukraine and his foreign lobbying and money laundering criminal charges.

In a court filing, Mueller's team claims "Manafort worked on the draft with a long-time Russian colleague of Manafort's, who is currently based in Russia and assessed to have ties to a Russian intelligence service," ABC News reported.

The filing from Mueller's team Monday asked the court to renegotiate the $10 million unsecured bail and house arrest agreement Mueller's office and Manafort's lawyers made last week. It asserts the op-ed reflects "an intention to violate or circumvent the Court's existing Orders." Therefore, "the government submits that the proposed bail package is insufficient to reasonably to assure his appearance as required," according to ABC.
