Federal judge blocks Texas harsh anti-sanctuary law

A federal judge in Texas has temporarily blocked a severe state immigration law that was supposed to take effect Friday and would have outlawed sanctuary cities and penalized local officials who do not cooperate with federal deportation efforts.

The decision Wednesday by U.S. District Judge Orlando Garcia delivers another temporary blow to the Trump administration’s campaign to compel sanctuary cities to detain immigrants so that federal agents can take them into custody.

“The Court was right to strike down the guts of a law that is not only patently unconstitutional but bad policy as well,” said Lee Gelernt, an ACLU lawyer who argued against the case in court on behalf of several Texas cities and towns. “Hopefully other states will now not follow Texas’ lead.”

The law, which would have imposed heavy fines, even jail time, on local officials who refused to assist federal agencies in working to deport illegal immigrants, will remain on hold while the lawsuit opposing it goes forward. ..................

Houston, Texas Mayor Sylvester Turner (D) praised a federal judge's decision to temporarily block the implementation of the state's law banning sanctuary cities.

"Happy to learn a federal judge blocked the Texas law aimed at making local police immigration enforcers. Need them for fighting local crime," Turner tweeted on Wednesday.

A federal judge issued a ruling temporarily Wednesday night blocking the law, which was set to go into effect on September 1. The bill would have made it a Class A Misdemeanor for a local law enforcement official to refuse to cooperate with federal Immigration and Customs Enforcement (ICE) agents.

Local governments have argued that ICE detainer orders, which order law enforcement to detain suspects suspected of being undocumented immigrants, erodes trust between the public and local law enforcement. The anti-sanctuary city bills are supported by the Trump administration and the Department of Justice.
