BCA warrant in Damond killing says woman 'slaps' squad car

A woman, possibly Justine Damond, slapped the police vehicle behind her Minneapolis home shortly before an officer inside the SUV shot and killed her, according to newly submitted court documents.

In an application for a search warrant filed in Hennepin County District Court and made public near the end of Monday’s business day, a state Bureau of Criminal Apprehension (BCA) homicide investigator wrote that about 11:30 p.m. on July 15 police responding to a 911 call arrived in the alley behind the 5000 block of Washburn Avenue S. and “a female ‘slaps’ the back of the patrol squad.”

The filing continued, “After that, it is unknown to BCA agents what exactly happened, but the female became deceased in the alley, approximately 10 to 20 feet north of 51st St.” after being shot by responding officer Mohamed Noor, a passenger in the squad.

The other officer in the squad, Matthew Harrity, has told investigators that he was startled by a loud sound near the vehicle before Noor opened fire.

A cellphone was found near Damond’s body, the filing notes. The family of the 40-year-old Damond and authorities have said that she called 911 to report a possible sexual assault in progress.

What a true tragedy. I can see it now, she slapped the police car notifying them she was approaching. Tragic.

So, if she slapped the car she probably just thought she was letting them know she was approaching them, never imagining the sound would be interpreted as a threat. I guess the thing to do if you're dealing with police as a witness is to approach them very slowly, showing both hands, and not holding anything. Keep your phone in your pocket or they'll assume it's a gun.

I live near the neighborhood where this happened. The other day I had the police come out because I had to get a police report on some vandalism to my property. When the squad car pulled up I actually stood on my steps, empty handed and phone in my pocket, and didn't walk toward the officers until they were both out of the car. I know that sounds dumb (old white lady on her own front steps in broad daylight), but this incident made me wonder how many officers are so jumpy that they'll shoot at anything.

I live 5 blocks from where this happened and If I needed to call the police I would do exactly the same. I would probably not call them at all for anything but the direst emergency.

I've been talking to doormen/bouncers and they are extremely reluctant to call the police. If there is an altercation in a bar, they're trained to separate and de-escalate the problem. Bringing cops into the picture only re-escalates the problem and increases the odds of a lethal outcome.

No way in hell will the mayor, chief and DA stick their political necks out to protect a dark-skinned cop with a muslim name who only has a couple years on the force after he kills an attractive white female...

It's also strangely odd that the media in this country haven't yet dug up her past and started printing the smear pieces about getting a speeding ticket 20 years ago or something... The media has also unquestioningly given her the benefit of the doubt in that she wasn't doing anything improper or did anything to bring death upon herself... God, what I wouldn't give for black folks to have this courtesy.

is Mike Freeman. Being County Attorney he has already decided that there will not be a Grand Jury call up. He made the statement that he alone will bring charges if necessary after reviewing the BCA Warrant and findings.

Remember,like Castile,there is a payout based by State Statute that caps payments at 1.5 million. Castile family received some where around 1.3 million as per the Star and Trib. You now see a pattern by some Police Departments to just put numbers on the streets. Bottom line,some one screwed up and it only cost them 1.5 million.

with her She-Hulk type strength. It must have been terrifying for the poor officers watching almost helplessly as their car began to crumple under the force of her blows.

Is they also executed a search warrant on her residence. Apparently it claimed they were looking for weapons, illegal drugs or writings showing intent. Perhaps she was a blogging about her desire to slap a police car??

Legal experts on local news stations all say they can conceive of no probable cause why there should have been a search warrant on her residence.

I've been very suspicious of the slowly evolving story that the police have released. I doubt that either of them heard any loud noises. I doubt that anybody slapped their car.

I think that she approached the car to talk to them and one of them panicked and shot her.

This. Is. Bullshit.

If police departments want to do something, however small, about the outrage people feel about such shootings then they've got to realize that nothing needs to take that long. Maybe investigating something truly complex like a plane crash or building collapse, but two cops, one dead person, at the most how many witnesses?

This is not a complex investigation. The most labor intensive part is going door to door looking for witnesses.

So far, that I know of, the woman in question of being assaulted has not come forward.
