Woman: On-campus rape was followed by 8-hour interrogation

Alanna Durkin Richer, Associated Press

Updated 12:07 pm, Thursday, October 13, 2016

RICHMOND, Va. (AP) — An Old Dominion University student who reported she was raped in her dorm room is charging that campus police prevented her from getting a medical exam to preserve evidence until after she was interrogated for almost eight hours.

Her complaint to federal education officials about the October 2014 episode also says she was not given written information about her right to seek a protective order against the person she said attacked her, among other things. It accuses school officials of mishandling the case.

The complaint obtained by The Associated Press says the woman, who was not identified, told campus police after she was raped in her dorm room that she had an appointment at a local medical center for a forensic exam. Instead of taking the woman to the appointment, police took her to their department, where they held her for nearly eight hours and denied her food, water and access to the bathroom in between interrogations, the complaint says.

In a personal statement included with the complaint, the woman said the detectives made comments and asked questions that made her feel like she was "being violated again," including "Do you like rough sex?" and "I'm just trying to find the crime here." The experience left her with ongoing post-traumatic stress disorder and an anxiety disorder, she said.

They also do this to prevent people from reporting. Anything to protect the rapist and abuse the victim further. This is vile! Hope she wins her case, but sadly odd are not in her favor due to goo old boy system and Americas rape and abuse tolerance.

They're trying to protect their reputation. Which is reprehensible.

When the perp is an athlete, especially a star, or is rich, they do protect them at times. Look at what happened at Stanford for an example of this. Even below that level, think it's protecting the men because they do discount it unless the woman is viciously and obviously physically injured. I used to be a rape crisis counselor so have some experience with this,

2. I was a University Police Officer.........

One night I was the only female officer on duty..(there were 3 females on the force). We had a woman report a rape, I responded. I immediately took the woman to the hospital & called the local rape crisis clinic.

There was no waiting 8 hours, she was at the hospital within 10 minutes and a woman from the crisis clinic responded to the hospital within one hour. This was 25 years ago & that's what was supposed to happen.

The victim did not press criminal charges through the court(s). She did receive ongoing support from crisis clinic counselors. She did press charges against the student involved through the university disciplinary system. I testified, and I remember having to tell one of the members of the disciplinary court (a female dean) that no the victim did not have to have injuries of a restraint or marks from a beating to have been raped. Though he was not expelled, he was suspended for 2 semesters and not permitted near the student upon his return. He did not return to the university after his suspension, the victim did graduate.

What the hell is wrong with the system 25 years later, that university officials do not understand.

and BTW I received a commendation for my work that night with this victim.

Unbelievably still rare, from what we hear.

No doubt the woman still clearly, and gratefully remembers the concern and respect you gave her after she had been wildly violated and abused.

An Old Dominion University student said campus police prevented her from getting rape kit

By Sarah Harvard
October 13, 2016

A student at Old Dominion University filed a complaint to federal education officials claiming campus police prevented her from taking a forensic medical exam after reporting she had been raped, the Associated Press reported.

The student said campus officials interrogated her for 8 hours in October 2014 after reporting her rape and failed to inform her right to seek a protective order against her perpetrator.

According to the complaint obtained by AP, the unidentified woman told campus police she was raped in her dorm room and scheduled an appointment to take a rape kit at a medical facility nearby — a forensic exam sexual assault and rape victims take to preserve evidence — the same day. The campus police responded with an 8-hour interrogation and denied her access to food, water and the bathroom throughout the whole incident.

. . .

Under the Clery Act, federal law requires schools and authorities to provide victims of sexual assault with tangible information about the importance of taking a rape kit, using counseling and mental health services, and that they have the right to postpone reporting the crime to law enforcement. A school can face a fine up to $35,000 per violation of the Clery Act.
