Even if Gov. Rick Scott’s (R-FL) administration prevails in its new lawsuit against the Obama administration, his efforts to purge voters before November’s election still faces a major obstacle — the county elections supervisors, including 30 Republicans, who have the ultimate authority over the voting rolls.

Republican Ann McFall, county supervisor of elections for Volusia County, told ThinkProgress that the lawsuit does not have her support and she will not resume purging voters before the elections, regardless of the suit’s outcome:

No I do not support the lawsuit. It is about helping the Governor and Secretary of State improve their image. I am not doing any further voter purge until after Nov 2012.

DEPARTMENT OF JUSTICE SUES FLORIDA OVER VOTER PURGE | The U.S. Justice Department is suing Florida after the state disregarded the federal government’s request to suspend its voter purge campaign. In a letter to the Florida Secretary of State, Assistant Attorney General Thomas Perez argues that Florida is violating the National Voter Registration Act and the Voting Rights Act. “Please immediately cease this unlawful conduct,” Perez writes. And get them reregistered. They have about 116 days to get this done.

They also need to change the law in Florida that includes party registration on the form.

Purging is best left to a time when there isn't a major election. When they require voters to bring identification to vote they wouldn't have to be concerned about someone voting who shouldn't.

The Florida association of supervisors of elections (not an official name) got an opinion from their legal counsel that cited the NVRA:

Attention Leon County Voters

The Leon County Supervisor of Elections office has determined the federal National Voter Act of 1993 (NVRA) prohibits the systematic purging of Florida's voting rolls in the manner described by the Florida Division of Elections for the non-immigrant matches in the Florida Voter Registration System. Accordingly, our office will not contact voters about this issue during the 90 days prior to any election containing federal races.

A statement from the U.S. Department of Justice web site describing Section 8 of the NVRA follows:

1. Does Section 8 impose any time restrictions on States as to when a general list maintenance program can be conducted?

Yes. Section 8 requires States to complete any program the purpose of which is to systematically remove the names of ineligible voters from the official list of eligible voters not later than 90 days prior to the date of a primary election or general election for federal office. This 90 day deadline applies to state list maintenance verification activities such as general mailing and door to door canvasses. This 90 day deadline does not, however, preclude removal of names at the request of the registrant, removal due to the death of the registrant, removal due to criminal conviction or mental incapacity of the registrant as provided by State law, nor does the deadline preclude correction of a registrant's information.

Fla. election chiefs skeptical of voter purge

Florida's local election supervisors on Wednesday sounded skeptical, and even distrustful, of a push by the state to remove thousands of potential non-U.S. citizens from the voting rolls just months before the critical 2012 elections.

The supervisors, meeting at their annual summer conference, peppered state election officials with questions about the list of more than 2,600 people who have been identified as being in Florida legally but ineligible to vote. That list was sent to supervisors recently, but state officials have also said there may be as many as 182,000 registered voters who may not be citizens.

State election officials want the state's 67 county election offices to reach out to those on the list, determine their citizenship status and remove them from the rolls if they are not U.S. citizens.

But election supervisors - including Democrats and Republicans - asked a range of questions about the level of proof that state election officials had regarding the citizenship status of voters which was culled by comparing voter registration lists to a state driver's license database. They said they wanted more information before they purge someone from the voting rolls.

Someone from my area who was a Naturalized citizen was purged. She is a Democrat as are many others. She sent the state her passport but even that is not good enough. She wrote the paper she will have to hire a attorney. How many others will bother especially with the threating letter the state of Florida writes them. It actually threatens them with prison if they vote or have in the past. And then a box to check if you request a hearing. I hate this governor
