Pedophile pediatrician loses Delaware Supreme Court appeal
Source: AP
DOVER, Del. (AP) A former pediatrician serving life in prison for sexually abusing scores of children has lost an appeal before the Delaware Supreme court.
A three-judge panel on Thursday rejected Earl Bradley's claims that his trial and appeal attorneys were ineffective, and that he was denied the right to have an attorney of his choosing. In a 21-page opinion, the panel upheld a Superior Court judge's ruling similarly dismissing those post-conviction arguments.
Bradley is serving 14 life sentences.
In 2012 the state Supreme Court rejected Bradley's argument that homemade videotapes showing him brutally attacking young patients, including infants, were seized illegally because police used a defective search warrant.
According to court records, police were able to document more than 100 incidents of sexual abuse. Prosecutors presented 89 separate incidents captured on video recorded by Bradley between 1998 and 2009, involving 86 individual children. The vast majority of victims were infants and toddlers, with an average age of about 3.

...that he was unable to afford an attorney of his choosing after the state filed a civil racketeering claim against him and put a lien on his assets.
Justice Karen Valihura wrote for the Supreme Court panel..."Bradley never asserted a right to choice of counsel (nor) ...challenged the racketeering complaint or the racketeering lien placed on his assets in the proceedings leading to his conviction..."
The defective search complaint seems to stem from a deleted video the police recovered from an external drive found in a storage building at his workplace. Sorry, but recovering deleted files from drives that you own is not only possible, but perfectly legal -- ain't technology great.
So if the courts hadn't been able to seize any evidence, and had allowed him to hire the lawyer he wanted, he would have been acquitted? A miscarriage of justice indeed!

(11,519 posts)I'm not so keen on law enforcement's ability to place liens on private property before someone is convicted.

(2,382 posts)... "short eyes" don't usually last too long in gen pop. Bradley should suffer pain every day for the rest of his miserable life, and I hope it's a long one.

(2,382 posts)... of Penn State fame, or a horrifying number of Catholic priests, are any indication, these mutants honestly don't think they did anything wrong. There appears to be a bizarre disconnect in the moral circuitry of predatory pedophiles. And the recidivism rate among sex offenders is really high. He needs to be reminded of just what a POS he is on a daily basis. And I hope it hurts. A lot.

Good riddance to bad trash. May he live long and suffer.
