Court: FBI OK to not notify of Minutemen home invasion

TUCSON, Ariz. (AP) — A federal appeals court has ruled that the FBI didn't have an obligation to notify local authorities about a planned home invasion that later resulted in the deaths of a man and his young daughter in southern Arizona.

The 9th U.S. Circuit Court of Appeals upheld a lower court's dismissal of the lawsuit brought against the FBI by the family of the victims in the deadly 2009 home invasion in Arivaca.

The case by Gina Gonzalez claimed the FBI knew that the activists has plotted the home invasion but didn't alert local authorities, resulting in the murder of her 9-year-old daughter and 29-year-old husband, Raul Flores, while Gonzalez played dead.

Three suspects were tried and convicted, including Shawna Forde, founder of the Minutemen American Defense. The militia group targeted illegal immigration.
