nominate Scalia's replacement. He should do it at the soonest available and possible time after thoughtful deliberation and consultation.

And then, in my opinion, he should cram the nomination down the Republicans' throat and shame them exuberantly if they balk.

The Supreme Court Justices should step down
at least a year before they expire. Probably save us

waste a lot of time letting the country know he was going to nominate Scalia's replacement.

This is such a big story. Probably going to get to be an even bigger one in the coming days and weeks.

highlighting the issue could bring more liberals to the ballot box

A case similar to Bush v. Gore could wind up 4-4 and head to the House

Republicans showing their try colors could alienate some

It really could play into HRC's wheelhouse, elevating choice to #1 issue

Obama will be cerebral, classy, and relentless. He is SO competitive.

Strictly stated, the Constitution requires the President to appoint a new Supreme Court justice and the Senate to approve (or disapprove) of the selection. There's nothing in the Constitution that says, "when it's politically advantageous to the Republicans."

There is no exception in the Constitution because one political party obsessed with "shoving things down throats" has a sad.

Fuck the Republicans on this one. I don't care if Obama was due to leave office next week, he has the authority and the duty to nominate justices. If I were him, I would line up 6 or 7 candidates and dare the GOP to pout in public about how unfair it is to follow the Constitution in an election year...THAT would be priceless TV.
