Ky. Clerk Won't Have To Issue Gay Marriage Licenses While Case Goes To Appeals Court

MOREHEAD, Ky. (AP) — A Kentucky county clerk who objects to same-sex marriage will not have to issue marriage licenses while she takes her case to a federal appeals court.

Rowan County Clerk Kim Davis is being sued by two gay couples. U.S. District Judge David Bunning ordered Davis last week to issue the licenses despite her objections.

On Monday, he granted her request to stay his decision while she pursues her case before the 6th U.S. Circuit Court of Appeals.

Davis has refused to grant marriage licenses to anyone in Rowan County since the U.S. Supreme Court legalized same-sex marriage nationwide.

in a civil rights case does indeed get attorney fees paid. And the damage award is often levied personally on the defendant.

Considering what a slam dunk the case is, you will likely see your wish granted.

Chat outside the courthouse among the protesters says that Ms. Davis, the County Clerk, is on her fourth marriage, though nobody thinks that diminishes her faith. Her mother held the post for some years; her son serves as her assistant. That’s not mean, angry conversation. It’s a headshake from people who know her and are sorry it has come to this. (The same chat says at least one employee is gay, and so the county may be looking at a hostile work environment.)

I would prefer they replace her with someone else. Even if she would, I wouldn't want her a part of anything I do.

My 2 cents.

Just because somemebody believes in a diety that does not give them the right to act
as that diety and tell other people on how to live their lives.

Boy I would be pissed if our county clerk refused to do her job and then wanted the citizens to pay her legal bills because she refused to follow the law.
I would be working on a recall petition right now.

A government official refusing to perform official duties based on her personal religious beliefs both respects an establishment of religion, specifically whatever hard-right cult Kim Davis belongs to, and prohibits the free exercise of any religion that doesn't bar same-sex marriage.

I'm certain the fundamentalist law firm that's representing her will use Hobby Lobby as precedent, but the plaintiff in that case was a private business. Private businesses can have any religious beliefs they want; the Rowan County Clerk's Office is not a private business and is therefore required to be inclusive. I'm fairly sure Mrs. Davis would issue a marriage license to a white man marrying a non-white woman, even though the Bible plainly says not to mix the races. (For those keeping score, this was Maurice Bessenger's excuse when he tried to defend his barbecue joints' "we don't feed n*****s" policy.)

Davis faces fines and a possible jail sentence for contempt of court if she loses the lawsuit, but she can only be impeached from her $80,000 a year job by the state legislature, and lawmakers won’t reconvene until January.
