Federal Agency: HealthBridge Must Rehire Fired Union Steward

The National Labor Relations Board in Washington has affirmed the decision of an administrative law judge in Connecticut 16 months ago that HealthBridge Management broke the law when it fired a union steward at one of its nursing homes.
The board confirmed that Patrick Atkinson, a dietary aide at Long Ridge of Stamford, should be rehired and receive back pay since his dismissal in February 2012. The ruling, issued Tuesday, says that Atkinson must be rehired within two weeks, and that the company must pay the additional taxes he will owe because of the back pay lump sum.
The Service Employees International Union, District 1199, had challenged the firing of both Atkinson and Tyrone Williams, a housekeeping employee who was fired in January 2012.
The judge ruled and the board agreed that Williams' firing was unrelated to his union membership and was instead a result of his behaving disrespectfully both to a client and to his supervisor when she criticized his actions. Atkinson was representing Williams during his dispute with management.
