City Of Cleveland Claims Tamir Rice’s Own Actions Caused His Death

The city says the 12-year-old shot dead by a police officer while holding a toy gun did not “exercise due care to avoid injury” in the incident.

The city of Cleveland is claiming that Tamir Rice, the 12-year-old boy shot dead by a police officer in November while holding a toy gun, died because of the actions and choices of him and his family.

The city made the argument on Friday in a response to a lawsuit on behalf of the boy’s parents and sister, Tajai. The lawsuit lists Timothy Loehmann, the officer who shot Tamir; his partner Frank Garmback; and the city of Cleveland as defendants.

It lists 27 counts including negligence, civil rights violations, and battery against Tamir and Tajai. The Rice family is asking for damages and a jury trial.

Cleveland officials stated they could not fully respond to most of the counts because of an ongoing investigation into the incident by the Cuyahoga County Sheriff’s Office.

I'd rewrite it as " “Plaintiffs’ decedent’s injuries, losses, and damages complained of, were directly and proximately caused by the failure of police to exercise due care to avoid injury.”

The investigation was transferred from the Cleveland Police Department to the Cuyahoga County Sheriff’s Department after Cleveland Mayor Frank Jackson said it required “an extra layer of separation and impartiality.”


Good for that but not sure if it'll be enough.

... every single one of the malicious mutants involved in this composing this obscene statement considers him- or herself a "good" Christian. Well, they had better like warm, 'cause Hell is where they're headed for this, and I hope they get the express elevator down!
Did these jerks even SEE the video? The poor kid didn't even have time to turn around before that malignant f**k opened fire. He wasn't out of the cruiser a full second before he cut that kid down. And the previous department to which he had applied rejected him as "...too mentally unstable" to be a cop, and that bar is pretty low.
Stories like this enrage me...

There was no time to make a decision, let alone a poor one, before he was shot and left on the ground to die.

This is fucking deplorable!

Sue the shit out of that department and take everyone of these people involved down!
