Man convicted of hate crime in 2013 Old Market assault

A Missouri man was convicted of a hate crime in the October 2013 assault of a Marine outside a restaurant in downtown Omaha's Old Market.
The jury of five men and seven women deliberated for three hours before finding Gregory S. Duncan guilty of the hate crime.
Duncan faces up to 20 months to five years in prison. It is believed to be the first hate crime conviction in Douglas County based on sexual orientation.
Prosecutors had asked jurors to convict Duncan, 36, of a hate crime under the theory that he sucker-punched Ryan Langenegger after hounding Langenegger's friends because they were gay.

I thought a hate crime had an automatic at least 5 year sentence? Maybe federal? Am I dreaming?
