Earlier this afternoon, Bloomberg reporter Sahil Kapur revealed that Senate Majority Leader Mitch McConnell (R-KY) has decided that no matter the result of the election between Trump-endorsed, pro-slavery child molester Roy Moore and Birmingham bomber prosecutor Doug Jones that fill-in “Senator Strange is going to be here through the end of this session.”

Luther Strange was appointed by the previous governor of Alabama, who was forced out amid his own sexual misconduct scandal to fill now-Attorney General Jeff Sessions’ seat.

This is now the THIRD time this A-hole has subverted the Constitution in order to get his way. I hope Democrats remember this nonsense when they regain the majority. Refuse to seat ANY Republican EVER for ANY reason. Then when the Republicans scream about it, you just say, "Hey, your boy set the precedent. We're just following it."

...by making the call before the outcome, he avoids the specific charge of partisanship. He's got Luther in place as a "yes". Why risk it on Moore or Jones.

All he's saying is that he's going follow the laws of the state - the election ain't over until the SoS certifies the results sometime in the next 2-3 weeks.

No way was anyone coming out of this race before the tax vote so it was a non-announcement.

According to Alabama law the election won't be certified until between December 23 and January 3.

So I thought he wouldn’t actually be sworn in and everything until the new year. I didn’t think he’d be voting on this bill anyway if they keep the vote in December.

Considering what Mitch McTurtle did withObama's SCOTUS nomination, I think Franken has every right to use the same kind of interpretation of time. To paraphrase the Declaration of Independence, it is his right, it is his duty.

I'm no expert on election law, but I wouldn't think Jones would have to be seated until start of next session.

They expire at the end of a Congress.

Bills can and do carry over from the first session of a Congress to the next. They die when Congress adjourns "sine die" at the end of the second session.

It wasn't going to be about what they would do with Moore, it was going to be about what to do about Jones.
Who the fuck ever votes for these criminals?
I have never realized before this year, how much I love our country and constitution and the men and women who built it.
The GOP on the other hand, HATE the U.S. and the constitution. They are making this obvious with each passing day.

A new Senator cannot be seated until the election has been certified by the state from which the Senator has been elected. Most states have processes for certifying elections that take a week or so, sometimes longer. My understanding is that the process in Alabama takes around ten days, but the intervening weekends and holidays will stretch it out to the end of the month.

There is a process for accepting a new Senator's "credentials" spelled out in the Senate's rules -- the Secretary of the Senate has to accept a certification from the Secretary of State of the newly elected Senator's state.

I swear they are at the level of "if I can't see them, they can't see us" mentality. Clearly they think we are all dumb and blind like their voters.
