He could have bought a brand-new full-auto machine gun, or a used military surplus one, for a reasonable retail price plus an (expensive for the time) $200 tax stamp.

There was absolutely nothing preventing a person in the 1940's from buying a FULL AUTO Tommy gun or Browning Automatic Rifle, walking into a theater full of people entranced with "The Wizard of Oz" (wow, color!) and gunning them down.

It just wasn't done.
