Fortunately, that's probably not permissible. McCain and Mini-Me Graham want him declared an enemy combatant so that can be done, but it won't happen. Almost all suspected terrorists (the live ones, anyway) have been tried in civilian courts just like any other criminal, and are cooling their heels at Club Fed. To name a few: Richard Reid, the "shoe bomber," Umar Abdul Mutallab, the "underwear bomber," and Ramzi Yousef, who masterminded the first WTC bombing. There are many others.
