Modern American history has never seen as full-scale an effort to sabotage a valid law as we have with President Trump and the Affordable Care Act a law whose legality has been upheld twice by the US Supreme Court.
The president has a legal obligation, under Article II of the US Constitution, to "take Care that the laws be faithfully executed." That means he must make sure that our laws are implemented in good faith and that he uses his executive discretion reasonably toward that end.
His agencies likewise have a legal obligation, under the Administrative Procedure Act the statute that sets the rules for our entire federal regulatory apparatus not to use their power to engage in arbitrary action.
The intentional, multi-pronged sabotage of the ACA that we have seen over the past nine months reaching new heights since attempts by Congress to repeal the law failed violates both Trump's constitutional obligations and quite possibly the obligations of his Department of Health and Human Services.

(23,350 posts)If the subsidies are part of the law, then he should support them. If they are just something that BHO signed, but didn't go through congress, then DJT can (and did) reverse it with another signature. Nothing illegal here.
Sad, but it seems like it's just one more consequence of an uninspired vote last November.

(16,104 posts)The lower courts are technically looking at the argument already approved by the Supreme Court that the executive branch can make the subsidy payments on behalf of working citizens as a tax benefit, since Congress wouldn't authorize it under Obama.
The insurance companies will simply up their premiums and get the money in a monthly premium payment - as stipulated by law!
Unless Congress actually passes the new proposal which would take it out of presidential discretion.

Is this a Christian? No. Can he NOW be impeached? Yes. WILL he be impeached? Maybe, when his so called tax plan doesn't pass. Maybe THEN the wimpy republicans will go ahead with impeachment proceedings. That's what they are waiting for...the tax hike for the rich.
It's a sad place this country is in now. Extremely sad.

This Senate won't even censure him, they sure won't execute the proceedings and impeach him.
House is very within reach. Senate is an uphill battle in 2018.
Let's put in a legislation that will make it happen!!!

(14,577 posts)Republicans have been getting away with this, though, since their leadership met the night of Obama's inauguration in 2009 and agreed to go lock-step against EVERYTHING Obama and the Dems put forward.
Republicans have done their best to sabotage ACA any way they possibly could. Now, it's just that now Trump is being downright blatant about it.
He is indeed misusing his power, and has many times since entering the White House forsworn his oath of office. In fact, it was treason that got him to the White House in the first place.
Trump is an orange scorpion in our midst, stinging every which direction, merely because this kind of evil, unformed chaos is his nature.
