Could Obama's ATF have prevented sales of bump stocks?White House counselor Kellyanne Conway said on CNN Thursday morning that it's the fault of the Obama administration's ATF for not regulating the device. She was specifically referencing how in 2010, Texas-based Slide Fire pitched the device to federal regulators as a new way to assist people with disabilities to "bump fire" from an AR-15-type rifle.
But because a bump stock is not a firearm, the ATF classified it as firearm part -- so the ATF wrote in a letter that it approved it because it doesn't have any real jurisdiction over firearm parts.
"We find that the bump stock is a firearm part and is not regulated as a firearm under Gun Control Act or the National Firearms Act," ATF said in a letter at the time.

(182,957 posts)The ATF is a bureau of judgment calls. Drug enforcement agents can confiscate cocaine and arrest anyone in possession of it. But ATF agents must distinguish constitutionally protected legal guns from illegal ones, with the NRA and other Second Amendment activists watching for missteps.
In part because of these notorious cases, the bureau has operated in a self-protective crouch. It has stuck to small single-defendant cases to the detriment of its effort to combat gun trafficking, the Justice Departments inspector general found in a review of ATF cases from 2007 to 2009. To refocus its efforts, the ATF established Group VII and the other Southwest border units to build big, multi-defendant conspiracy cases and target the leaders of the trafficking operations.

The BATFE tech branch is a mess of epic proportions and has been for a long time- as is much of the rest of the agency. It recently came to light via FOIA requests that the registry used to keep track of machine guns is so badly managed the agencies own agents don't have confidence in its accuracy.

(6,324 posts)Read both letters from them. In 2004 they declared it was a machine gun. Then later in 2007 they rescinded that decision later and declared that the string itself was no longer a machine gun but that it would be if used to convert a gun.
For a 3 year period the decision on record from the BATFE tech branch was that the string itself would legally be a machine gun.
The pictures of the actual letters seem to load real slow on that site, so maybe you missed the pertinent letter since it was in image form.

(6,324 posts)There are things like a drop-in sear that will make any gun of the type it's designed for full auto. The BATFE says that the part is a machine gun all in itself and requires them to be serial numbered.
