Mueller thought of everything.

He chose to hold the Grand Jury in D.C., not the Eastern District of Virginia. If he chose the latter, after all the work involved, he could risk jury nullification.

You remember what that is: Jurors believe that evidence proves guilt, but votes not guilty to send a message. That was Trump's last stay-out-of-jail card.

they don't decide guilt or innocence. A grand jury's job is only to evaluate evidence presented by the prosecutor to determine whether there is probable cause that a crime has been committed. If the grand jury decides probable cause does exist it will issue an indictment, and then the prosecutor can take the case to trial. Therefore there can be no such thing as "jury nullification" with respect to a grand jury.

The reason this grand jury was convened in D.C. is because that's where the possible crimes under investigation would have been committed.

The fact that he is still managing his businesses means that financial crimes, if any, could have been committed in D.C. Also consider that it's not just Trump that will be investigated or called to testify. Some of the witnesses will be White House staff and FBI agents.

The political leanings of grand jurors will be irrelevant and probably would not even be known because no voir dire is permitted. The only evidence a grand jury hears is evidence of the alleged crime. No defense is permitted. Targets, subjects and witnesses are not allowed to have counsel present. Again, the point is not to determine guilt or return a conviction, but only to decide there is probable cause to justify an indictment (which is just an accusation).

In conjunction with the factors you mention, grand juries frequently hand in a true bill with the mindset "this isn't a conviction and the accused will have every chance to defend themselves in court before another impaneled group of citizens. Not really our problem and we did our duty."

The acts Mueller is investigating took place in DC. That is why Clinton's grand jury was in DC.


I think the grand jury in the Eastern District of Virginia was investigating Flynn's companies. Flynn's companies are located there is guess.
