I'm not an attorney, but I believe that judges have ruled that a prenup is between the two parties that signed it and cannot take precedence over a child's own best interests, ultimately determined by the court.

And the father is old enough to realize he may not be able to care for him until he's an adult.

There is a marriage-contract. But I can guarantee that custody isn't as important to him as his reputation and his money. The contract will be all about protecting him, not his custody of the child.
