That makes him a violator of the Hatch Act, that's why Comey is trying to deny that there even was an investigation in the first place.

on October 28th stating he was re-opening investigation of HRC emails because "new" which turned out to be duplicates were found on her staff member's laptop. They were looking at something to do with Anthony Weiner and that's when discovered the duplicate HRC emails.

When Reid tried to contact Comey regarding Trump, Comey ignored Reid. There's no reason why he would do that if he didn't have a political motive. That's what Comey is trying to cover up.

I'm just point out the context in why Comey's scared. If Comey and the FBI obtained information from the Trump campaign and sat on it, while calling out Hillary's campaign in the contemporary time frame, that attack would be seen as politically motivated, making him liable under the Hatch Act.

If Comey were taken to trial, there's no way he could objectively argue that he didn't violate the Hatch Act when he had information on Trump from the FISA warrant, but chose to sit on it, despite Reid contacting him to release the information regarding Trump and Russia. This was in the same time frame that he made a public statement after Chaffetz contacted him.
