Sure, they are desperate and pathetic, but they are talking about jailing an ex President simply because they want a distraction. This country is in the edge.

The enemy combatant designation is for "soldiers" or belligerents of a foreign power who are not conducting war in accordance with the Geneva Convention. Think of them as "non-uniformed troops". Uniformed troops are taken into Prisoner of War status. The SCOTUS ruled in 2004 (Hamdi v. Rumsfeld) that U.S. citizens designated as enemy combatants by the Executive Branch have a right to challenge their detainment under the Due Process Clause. This would include the habeas corpus challenge. If the government has clear evidence that they were fighting against it, they can try them for treason per Article 3, section 3.

They can't just go around throwing people in jail because they don't like them. Trump might think the rule of law means nothing, but the law doesn't care. He's going to get impeached if he keeps acting in bad faith.

There's no question we're in a battle now. We have been for years and years and it does seem as though things are coming to a head here.

When the phrase 'civil war' pops up, people logically think of bloody battles and brother against brother. Will that happen? Doubtful.

I will say this, though: coming for Barack Obama WILL rip this country apart. If you think it's divided now, you ain't seen nothing yet. Obama left office with high approval and by and large, Democrats love him - even the turncoats who voted for Trump. We're in illogical times with an illogical president. An Internet troll is running our government.
