Apparently, someone was asleep during his US Government class:
"Obamacare is wrong for Americans. It will destroy our health care system. This now means we fight every hour, every day until November to elect a new President and a new Senate to repeal Obamacare," he continued.

(10,960 posts)Marbury v. Madison is what it is. In that sense the Constitution is whatever five justices say it is. And that is the law.
In another sense, however, I routinely refer to certain laws the SCOTUS has upheld as being unconstitutional. That doesn't mean they are formally unconstitutional as legal precedent, but that the SCOTUS ruling is, in my view, incorrect.
Say Congress passed a law against praying in the direction of Mecca. A clear freedom of exercise violation.
And say the SCOTUS said, "Islam isn't really a religion, it's cult. And freedom of exercise doesn't apply to cults."
That decision would be wrong any way you look at it, and facially unconstitutional. It would, however, be the Constitution as is exists.
A person saying, "Outlawing prayer is unconstitutional," would, in my view, not be making an ignorant statement rebuttable by citing Marbury v. Madison.
But the SCOTUS decision would be the Constitution operationally... it would be binding precedent on other courts and other laws.
It's a tricky thing.
Anyway, as someone who believes that some SCOTUS decisions fly in the face of the Constitution I am not going to castigate someone else for holding the same view.
