As it is now the Court seems to be in stalemate status with four conservative leaning justices and four mostly liberal votes, which, IMO, stops the repugs from ramming through their most odious ruliings.

(53,784 posts)I'm not sure if they'll do it because they know they won't be in power for forever and they'll want the filibuster to be there when they are not.
It they do it, it'll work for us in the future.

Schumer's idea of supporting a "main stream" pick seems like the very best we can hope for.

(24,412 posts)but since Garland has removed himself from consideration and Trump probably isn't going to enrage his base by choosing a more "moderate" nominee and the Republicans would never approve anybody to the left of Scalia anyway, I say Dems should filibuster until the Republicans take it away- or until the next Democratic President takes office. I don't particularly like advocating for this and it isn't honest-to-goodness responsible governance but I simply can't abide by the slap in the face that Republicans gave to President Obama over his privilege to select a replacement for Scalia- with plenty of time remaining for the Republicans to have considered his nominee.
BTW, since the "McConnell Rule" is now a real thing, shouldn't we wait anyway, given that President Trump has already started his 2020 re-election bid?

(24,412 posts)Oh, and several Republican Senators and right-wing legal organizations are already on record saying that the Court can function fine at 8 (or less) Justices and were already declaring that Hillary wouldn't get any nominees confirmed had she been elected. Let's just throw it all up in their faces. They've paved the road for us.
