Some People Not Entitled To CONSTITUTIONAL RIGHTS To Be Argued By Trump Administration.

Just on Last Word a discussion on Constitutional rights.

Trump administration Justice department wants to establish a CONSTITUTIONAL FREE zone at the border in essence. That means ultimately it would give border agents the right to shoot illegal crossers. Based on a case of unarmed 15 year old being killed in 2010 on the Mexican side of the border. Also to argue that US has the power to discriminate based on national origin. Probably that such discrimination can be used in the face of national security.

Boy are we getting into the weeds big time.

The 15 year old Mexican was not unarmed as he was throwing baseball sized rocks at the head of the Border Patrol Agent, Jesus Mesa. If you don't think that having rocks thrown at your head is dangerous then you can try it out for your self.

The case included many complex legal questions, even if you assumed it was a bad shooting which was not the ruling.

Last year a Border Patrol Agent in Ajo, Arizona was hit by a rock in the head and was not expected to survive the assault. He has recovered and now does desk duty in the Tucson Sector.

Any assault, including those involving a shooting, is investigated by the Internal Affairs officers of DHS and NOT by the Border Patrol. There have been several cases where they have referred the case to prosecution and the Agents were prosecuted including the famous case of the two agents in Texas. Investigations into this case have not found that it was a bad shooting and the Obama administration filed a brief on behalf of the agent.

What is "Just on Last Word"? A Youtube channel? Who appeared on it? A blogger? Who makes these claims? What is their basis? Are they speculating? Is there any credible news outlet reporting the basic claim?

They are reporting on a case of a shooting by a boarder control agent in 2010.

The "Zone" commented on is the commentators characterization of the possible effect of a ruling on this case.

Again, this is from 2010.

My personal opinion, this is a continuation of the ongoing struggle to define exactly what Constitutional protections apply to non-citizens.

I would hope that unnecessary use of force, especially deadly force, to be a violation of basic human rights and therefore protected by our Constitution no matter the legal status of the person being harmed.
