he isn't. His nomination is illegitimate, period.
The same applies to ALL Trump nominees to fill the Scalia vacancy, except Garland, if he were to be nominated.

(115,836 posts)for the rest of my career. Will Gorsuch, who is actually one of the least disreputable of the Trump appointees (at least he has experience relevant to his job, unlike most of the others) feel at least a little weird or embarrassed when Trump is impeached?
