(21,852 posts)If an attorney believes that a judge is not able to hear a case impartiality, then can file a motion to have the judge recuse himself. The problem with that is that the judge accused of not being impartial hears the case. That judge of course determines that he is impartial.
Such a motion is a good way to piss off a judge.
Judges have a lot of discretion and you don't want to piss them off. They can exercise their discretion in ways that don't create appealable issues.

But someone up the food chain can assign that judge nothing but BS cases. Supposedly Judge Fred Nichol never got an important case after he dismissed the charges against Russell Means & Dennis Banks during the Wounded Knee trial. His reason for doing so was "It is true that a judgment of dismissal is not the only possible remedy in this situation, i. e. a new trial could be ordered. It is my belief, however, that the misconduct by the government in this case is so aggravated that a dismissal must be entered in the interests of justice."
Even though the 8th District upheld his ruling, he had still pissed someone off.
