In a terrifying prophecy, MSNBC host Chuck Todd began his Friday evening show saying 16 years later we may look at Donald Trump and hes still President of the United States. While Todd was likely popping off, hes not too far off base.
Ive also heard Donald Trump, boy, he wont even make it through the first year of the presidency, Todd said. Ah, Donald Trump will get impeached. Ah, Donald Trump will quit the presidency.
Dont count on it. Todd called Trump the defier of expectations. Continuing, 16 years later we may look at Donald Trump and hes still President of the United States.
While Trump has the 22nd Amendment to contend with, it might not be the barrier many assume. It takes two-thirds of the state legislatures to pass or repeal an Amendment to the Constitution through a Constitutional Convention according to LexisNexis. The Nebraska legislature is 3 members short of being controlled by the GOP. If it goes to the Republicans, the party will hold two-thirds of state legislatures and be able to pass a Constitutional Amendment to keep Trump in power as long as they would like.

Instead congress proposes them by 2/3rds vote in each house.

(19,429 posts)Two thirds of the states could call a Constitutional Convention. However, any amendment proposed by the convention would have to be ratified by three fourths (38 of 50) states.
Furthermore, it is completely unclear whether the Constitutional Convention can be restricted to considering only a specific topic. It is likely that once called, the convention is free to set its own agenda and consider any amendment it wishes, including replacing the existing text with an entirely new text.
Therefore, it is unlikely that the states will ever call a Constitutional Convention.

(5,325 posts)If repeal of the 22nd amendment was proposed at such a constitutional convention, it would still have to be ratified by three quarters of the states. Not very likely.
But first of all, understand that this method had never been followed and there are questions as to how such a constitutional convention could be pulled off today.
And secondly, it assumes that all of the states that have GOP majorities would be in favor of repealing Mr. 22, which is far from a safe assumption.
