No public defender for Chelsea bomber Ahmad Rahami, judge rules

The suspect in last weekend’s dual terrorist bombings of Chelsea and the Jersey shore has a doctor — but no lawyer.

A New Jersey federal judge rejected a public defender’s call Friday for a court-appointed attorney to represent accused terrorist Ahmad Khan Rahami.

The 28-year-old bomb-making suspect remained hospitalized under a doctor’s care in Newark, N.J., after his Monday arrest following a gunfight with police. Rahami was shot multiple times during the shootout in Linden, N.J.

U.S. Magistrate Mark Falk agreed with federal prosecutors who argued that Rahami didn’t need a lawyer because he had yet to be arrested by the FBI.

in what way is he not under arrest? just because no one has yet said the magic words?

put another way, why the hell haven't they arrested him yet???

he may be under sedation and not able to comprehend that he's under arrest. That could be the holdup. The prosecution objection is not great optics, but if he's unable to assist in his own defense, I'm not sure if makes a whole lot of difference at this point. He will be arrested in due course, and he will get a public defender at that time.

The minute they tell him he's under arrest and has the right to remain silent, that's when he needs to pipe up and demand a lawyer--and if he has a bank account full of cash, he can hire one. If he's indigent, one will be provided to him.
